Sent first letter off on the 3rd May asking for statements, recepived them on the 9th May, sent first letter asking for charges back on the 11th May and received offer in the post today.

After receiving all my statements and adding up the damage caused by Natwest, I sent my first refund request letter on 18th March 2007.
No response to that, so sent the second refund request letter on 3rd April 2007.
No response to that either, so on the 2nd May 2007 I filed with MCOL.
My claim was £2182.00 plus interest of £130.68 and £120.00 court fee, £2433.53 total.
Natwest were served with my intended proceedings on the 8th May, and they had until today (22nd May 2007) to respond. They acknowledged my claim today by the way!!
HOWEVER, last Monday I received an offer letter from them for £2260.00, which I promptly accepted and sent off my acceptance form!!
I thought I would have to wait forever, but I checked my online banking tonight to see if I needed to transfer any money to cover direct debits......
and my money is in already!! It went in yesterday!!!!:j
I know I could probably have held off and got every last penny, but to be totally honest I really need this cash NOW not in two or three months time when it goes to court!! When you add it all up it is almost two months wages for me, and its been a struggle to stay affloat without it!!
A success story for me, I feel great and I am sure I will sleep like a baby tonight instead of rolling pound signs in my head all night!!

Asked for copy statements November 06. Wrote to Barclays (using template letters) in December. They replied saying they would investigate but could take more than 4 wks & enclosed terms of banking leaflet. Just on 4wks they wrote saying whilst they didn't admit any liability they were prepared to make a goodwill gesture of £1000. I replied that would accept £1000 as PARTIAL payment but would be recovering remainder via Courts. They replied saying if I did not accept the offer as full & final payment it would appear we couldn't reach a mutually acceptable resolution. February 07 wrote to inform of my intention to commence court proceedings to claim full amount, interest upto date of judgement & fees incurred. Started Online Court proceedings & paid court costs of £120. Barlcays filed defence too long to show. Claim then transferred to my local court and the Judge ordered the claim extra time for Barclays & me to come to an agreement. Just before d day I received letter from Barclays saying they weren't admitting to anything but as it isn't cost effective to proceed through courts they would SETTLE IN FULL.:j I had to sign agreement & fax back to them, together with copy of letter cancelling court proceedings. MONEY IN MY ACCOUNT THE VERY NEXT DAY.:beer:

Phoned threatening Bank a few time in between was going to call tomorrow before finally going to MCOL. However checked on line today and they have paid up!

Received - £785.10!!
Who says that claiming from Egg is hard??!!
Sent preliminary letter on 25th April. received response on 1st May offering me £108. I sent LBA on 10th May saying I will accept partial offer but would be pressing on for the full amount. Received offer of full amount plus interest on 15th May.
2 letters, 20 days, full offer including interest = fantastic result for me!

Just got £3462.85 fees and inertest charged to my mortgage while i was in arrears , when I went through a bad patch. Got to poiunt of writing to ask for money back was then offered %)% , whiach I turned down. Within 7 days they sent a chaps payment to my bank account for the full amount.:beer:0

Bank: Halifax
Amount Claimed: £1302 + £120 charges
Amount Received: £1302 + £120 charges
Requested copies of statements under the DPA end of February - received these on the 39th day allowed under the DPA after a reminder call on the 37th day.
26th March - sent initial correspondence to Halifax Customer relations claiming under "Terms in Consumer Contracts Regulations 1999 Schedule 2(e)" and also noting that if the charges are a penalty they are irrecoverable at common law.
1st April - Received standard fob-off letter stating that they were investigating under teh FSA regulated complaints scheme, and that they had 8 weeks to reply.
2nd April - sent letter stating that the issue was not a complaint but a threat of legal action, and that they had the initial three weeks to respond.
18th April - sent final demand for payment within 7 days
26th April - Initiated court procedings via MCOL
1st May - Proceedings Served to Halifax Head office
3rd May - Halifax Acknowledge service of procedings
18th May - Received letter from Halifax stating that my initial complaint was invalid and the charges were lawful as stated in the agreed terms when opening yadda yadda yadda
22nd May - Received letter from Halifax stating that though they had acknowledged with intent to defent, on a commercial basis they were going to pay me out the full sum and my costs. Their reasoning was allegedly that the case would likely be allocated to the small claims track, and that they were unlikely to recover their costs. They also stated that the charges were lawfully applied, and that they accepted no liability.
So in summary
- If things aren't moving fast enough, a polite prod works well.
- Even in initial correspondence, mention that you will go to court if neccessary
- Prepare to follow your own timescale, and dont be fobbed off by their internal complaints procedure; you're threatening legal action, not making a complaint.
- Don't freak out if they acknowledge/enter a defence; the left hand often doesn't know what the right is doing, and there seems to be lots of cases where the complaints dept dismiss your correspondence, only to have the legal dept cash-out.
- No mention of my account being closed has been made (at least by them!!!)
Hope this might help, or even prompt someone into taking the plunge

Claim Acknowledged - Will Defend In Full.
Was about to file for judgement at 11.56 a.m. (Exactly 28 days after acknowledgement).
Special delivery envelope this morning - could defend but not cost effective etc, etc. - Cheque enclosed for full amount!!!!
Now - This claim only covers unfair charges until April last year. I will be calling into the branch with the letter and cheque and politely requesting that they refund all subsequent charges up to the present day. I have already set up Alliance & Leicester account and they're switching everything over so no need to worry about account being closed (implied in settlement letter).
Persevere!!!

Claimed: £657.78 (includes interest) plus £80 MCOL fee
Repaid: £744.95
I didn't expect such an early payment! Today received a much needed cheque for £744.95 from Northern Rock - submitted MCOL claim on 15th May! I was surprised that they didn't even wait for a court date and have repaid me "notwithstanding your failure to address the legal issues". (ie I wasn't scared off by their initial response).
Thank you Martin and everyone on this site. You made it so easy! Plough on everybody, don't be put off by stalling letters!0 -

The story: After reading the information provided on this amazing site, I bit the bullet and submitted the first recommended letter on 14th May. I then submitted the second letter on the 19th May, after checking through my statements.
I received the offer on the 23rd May! :j
