  • Thanks to any advice I have been given in this thread, claimed £1800, they justifiedly (sp?) took 150 off that as I had been refunded some of those charges (hadn't spotted this until ball was rolling), they refused any interest payment and got settlement for over £1050, accepted to save hassle of court and payment will hit my accuont by the end of today (i expect at 23:59:59 so they can get every 100th of a pennies interest they can)

    Anyway, not as much as I hoped.. but, at risk of turning this into a cliche, It was money that I thought i'd never see again

    Now... were are my HFC, Cap1, Citibank abd Barclaycard statements? lol :)

    Bank: First Direct
    Amount claimed: £543
    Amount paid: £508

    Two letters sent and they paid shortly after the 2nd was received.

    I have another claim in for Lloyds TSB £1,005 (without interest) that has now been put through Moneyclaim for this amount + interest. Bit scared about that one now due to the guy in the papers this morning losing to Lloyds TSB.
    The 14 days is up tomorrow so this gets pushed forward as no response.

    March - requested charges list (£10 fee)

    took about three weeks for list to arrive £235 including interest I added (well, why not?)

    Letter beginning of may offering £75

    Rejected it and asked for full amount including interest or I would go to court.

    MORGAN STANLEY FULL AMOUNT refunded £235!!
    CAPITAL ONE offer of £96 MCOL 28/04 MAY 25th FULL AMOUNT £309.85
    NATWEST VISA £515 FULL AMOUNT REFUNDED
    HALIFAX LBA CLAIMING £2376.31MCOL 08/05 SETTLED£2496.31 FULL AMOUNT REFUNDED

    All in all - £11,420+

    Just got off the fone with a very nice man from halifax (yes i know don't faint there are some still workin there ;) ) & we agreed on a figer of £4250.00 which is only £1650 less then what i was askin for, I'm happy as i did tell the guy that i had worked out the figers again as i belive i should get charged sumit but he's given me more then i was expectin sooo now waitin 2 see if i do get the money in 14 days or not ;)
    This will go a long way to paying off other things,
    this is a waight off our minds as we didnt even have to go to court, which is sumit we was worryed about cuz we couldn't afored the court fees,
    I just wanted to say don't give up, we never went to court, we waited the weeks they asked for, which i know lots on here tell u not to, but it worked out ok for us in the end, yes we would of liked the whole lot but hay this is a whole lot better then nothing + like i said i think we should get charged sumthing if we mess up :)

    Did it through FOS as amount was above the limit for Scottish small claims. Sent first letter to bank on 3rd March. Contacted FOS on 3 April. Paid up today.
    Only problem is they have made the cheque out to my old business name which I have sold so I can't pay in the cheque. :mad: Phone them about it so here's hoping I get a new cheque soon.

    Ok I have an up date for you . . . .

    I was a bit cheeky and rang the "very nice" guy at halifax back and told a little pork pie on how the other half was not happy with the amount we had said and so we barted a little untill we got to £4850.00, i said ok, then left it a bit then re rang, he said "hello" i said "hi it's me again" he laught and said "ok £5000.00!"
    How happy am I!?!? I'm over the moon.
    see it can pay to be a cheeky little b***** at times ;)

    forgot to say the total amount i was claiming was . . .

    £5183.00 with out interest & £5900.00 with

    So think i done ok ;)



    (just thought i'd add I got the letter offering me the £5000.00 on the 17th (yesturday) and the money is in my account 2day!! (18th) you rock very nice man at halifax ;) hehe)

    The story: Real quick within a few weeks had the refund.

    The story: Rhey were a bit of a truggle. Claimed in Jan finally got refund just a couple of days ago, after rejection letter which I replied to saying it was unaceptable

    After 5 months,4 letters and two from the Ombudsman they begrudgingly paid up.....but it still wasn`t their fault they had taken £1700 out of my account in error and left me in the red ?????????
