the story.
They really took me to the wire on this. i sent all the letters and declined an offer of £650 after mcol. This was because they back dated a letter and ran me around. they then held out until we had a court date and settled just a week before going to court.Scary stuff cos i thought i was going to court for the cash. But i didn't!!!
Hold on guys they will give it back to evntually!!!!!!:money:

26/04/07 Letter offering charges back via Customer Relations - declined in writing & by email
03/05/07 Cheque for full amount rec'd from solicitor (5 days before their 28 days were up)

story: I sent the letter asking for the data and they sent it back within 3 weeks. At the bottom it gave my balance as -£2,941 and then in the next column it said +£2,943 !! when i added up the charges it only came to £770!!
so i phoned up to check and they said it was right. I can now close the account, its even in credit by £24! really happy :j :j :j0 -

Sent off the standard first two letters and got the usual delaying repies from bank.
Had till 2nd May to reply but just got another delaying letter, so called them to ask the state of play with claim and said that if no offer was made by close of business we would go ahead with MCOL.
Offer was made on the phone there and then and we have accepted, after all it is money we never had before

I sent the 1st letter on 7th March 2007, got a letter back saying they would look into it, sent 2nd letter on 13th April, got letter today saying that as a gesture of goodwill they will refund £341.

I went through all my last 12 month's charges on all my Smile accounts and worked out I'd paid about £445.
I did the first letter asking them politely to refund the money and after about 35 days or so got a letter offering me £335!
I was so chuffed as I didn't expect it to work, I decided not to pursue them for the rest, but am relentless at getting them to refund any further charges since (they must hate me, but it's working!)
Now I'm waiting for Barclays to send me the details of the last 6 year's of charges (sent my cheque for £10, but not yet cashed). The 40 days reply period is up next Tuesday, and so I will have to chase them up for a response.
Looking forward to that one, as I reckon I've paid them loads over the years! Plus I no longer have the accounts, so no fear of them closing it on me!
I have told all my friends and I reckon everyone has now written to their banks - Vive la revolution!!! How exciting!!!:beer:0 -
Claimed £3500 on behalf of husband, offered £2300 which he wanted to accept. (I would have gone to court, but that's me!)
Very pleased, just waiting for Abbey to settle (hopefully) before the hearing mid May.
