Had a hairy moment when they filed a defence, and I thought I was going to have to go all the way, but then within a week they paid the money into my account!
Now going to start on the credit cards ...!

I today received notification from Lloyds TSB that they are refunding ALL my charges - to the tune of £750.00 in addition they are waiving a further £30 that they were due to charge to my account this month! How Kind they are
Thanks MSE for your help - I followed your instructions and used your template letters. 1st letter produced a thanks but not thanks response from LTSB, so I sent 2nd letter - 5 weeks later I receive confirmation of my success.

Actually issued Court Summons online for this one. They responded by saying that they do not admit liability but as it would be costly for them to attend court to defend it. they offered the above amount to include the £120 court costs, interest and the overcharges. Basically my son thought this lot gone forever. We are so grateful to you for showing us the way. IT WORKS FOLKS !!!

sent all template letters also moneyclaimonline, Northern Rock acknowledged service of claim and were preparing their defence, 3days before the 28 days expired received cheque. YA HOO! Result

This is my first post on here but I've been using the site for some time to get information on claiming back my bank charges.
I have gone down the same route as everyone else, sent all the letters to no avail, then took my bank (Natwest) to court via MCOL. I used all the templates and wordings from this site and also the Consumer Advice Group website.
I was really worried when it got to the court stage. Even more so when the bank stated they intended to defend the claim and the case was transferred to my local court (more money to pay out!!!!).
However, thanks to everyones posts on here and on the CAG site, I stuck with it and today received a Special Delivery letter from Cobbetts. I expected the worse as I had written to Cobbetts accusing them of intimidatory tactics in trying to get me to complete a CPR Part 18. However, I was in for a shock.
The letter gave it all the usual waffle that I've heard all the time. Our client considers that your challenge would fail in court. Its charges are fair etc. They then went on to say that although our client is confident that it will be successful at a final hearing, it's legal fees will almost certainly outweigh the value of the claim, and, as such, our client must take a commercial approach to such claims.
The bank have settled in full (just under £2800) and have enclosed a cheque with the letter. Subject to the usual conditions about not disclosing any details etc. Yahoooo. Can't believe it. Wasn't expecting that. I've been driving around all day with a huge grin on my face and whooping and hollering every five minutes.
This more than wipes out my overdraft now and means I can pay off a few other things as well.
They have put one interesting point in the letter though. They say any further charges on my account will be in lien with the banks published tariff and if I am unwilling to accept any such charges then the bank may need to consider if it is prepared to continue to provide me with my existing banking facilities. Instead the bank may offer me a simple account that does not offer borrowing facilities or other services that can result in charges.
So it looks like the bank won't be closing my account either.
Sorry this is a bit long winded but I am so happy. I wanted to post this up to give hope to others that the banks will back down. You just have to hang in there. Go for it.

The story-after sending a letter to Nationwide asking for the charges to be refunded, i took them to court. THey said they would defend all of the claim, but paid up in the end

The story-after writing to IKEA asking for the charges to be refunded, they wrote back offering me 50% of the charges, which i accepted.0 -

I was dreading doing this as I was terrified of having to go to court but it was really easy.
I sent the template letter from this site asking for the charges to be refunded and they wrote back straight away saying 'No'.
I then contacted the Financial Services Ombudsman who contacted them on my behalf and about 4 weeks later the full amount was refunded!
Job's a good'un!
They have not yet asked me to close my bank account but I am waiting and kind of expecting them to. I'll update here if they do.

Inspired by this site, the Whistleblower documentary and in general, the attitude of Barclays with whom I have held an account for 22yrs (if only we can go back 22yrs for charges!!)
Anyway, I rang Barclays data protection centre 15th March for statements and was advised it could take 40 days etc. As 40 days expired this week, I called a number I found on the CAG site, 0800 282 390 . Spoke to a wonderful girl called Marie who apologised, kept me online and said she was able to extract my 6yrs of statements and mail them out soonest. I got them the next morning, so a tip to all waiting to receive, call this number and you may be pleasantly surprised.
I had alot of my statements kept back anyway, so after a quick browse sent my first letter requesting charges on 23rd March 2007.
Normal response and that they had 8 wks to reply but would write back by no later than 25th April 2007.
As per this site, I stuck to my timetable and after 14 days sent a second letter before court action on the 6th April. I stated that unless I received notification of refund of charges that I would correspond no longer and go straight to small courts claim procedure.
On 25th April no letter, rang Barclays for an explanation. They gave the normal story of how busy they are with this business. I couldn't resist in telling them that this had been on the go for over a year and they should be resourced enough to deal by now, particularly as they are now amongst the highest profit making banks, that was met with silence..chuckle.
To my surprise, yesterday, 26th April received a letter from customer relations Leicester (where I sent both letters by the way, not London) as follows:
Dear xx
May I say how sorry I am to learn that you feel the bank charges you have incurred are unfair. In your correspondence you have referred to elements which you feel support your claim. Barclays is aware of the information you have drawn to our attention. I must inform you, however, that we disagree with your view.
When an account is opened with us, our customer is provided with a copy of the terms and conditions relating to the use of their account including details of charges..blah blah blah (letter rabbits on about fair banking code etc.)
Despite my comments above in relation to your views, on this occasion, and without any admissions of liability, I am willing to offer the sum of £1965 towards the total amount you are seeking. This is with the cost and inconvenience inherent in a further dispute in mind and is intended as a gesture of goodwill, in full and final settlement of your complaint. If you would like to accept my offer please sign enclosed form and return in prepaid envelope and money will be credited to your account within 10 days of receipt of your acceptance at this office.
If dissatisfied with my proposal for resolving your complaint you may ultimately refer to the FOS.
In accordance with our standard practice, if I do not hear from you to the contrary within 8 weeks of this letter, I shall assume that your complaint is resolved and close my file

So there we have it. Thought I would show this letter to give people an idea of the response I got.
On this occasion, I have decided to accept as it is almost what I asked for, actually more with interest deducted that they are only obliged to pay after court papers.
I must admit as well, in all my dealing on the phone on progress of this etc that Barclays staff have been more than helpful and polite, maybe severe damage limitation after all the media coverage. Doubt if it will stop them continuing the charges.
The lady I spoke with said that the banks believed shortly there will be a FOS statement and charges will settle around the £10-15 charge similar to credit card review.
Many thanks to Martin for pointing me and the whole of UK to taking action, my stomach churned going through my statements seeing the gross charges that actually kept making me overdrawn, not my misuse of account and they have finally refunded what was mine in the first place.
KEEP AT THEM TO ALL CONSIDERING AND IT REALLY WORKS.

I got the standard stalling tactics from the bank but I persevered and in total sent three letters requesting reimbursement which they totally ignored and said they were "looking into my complaint". I raised a claim in the small claim court and 14 days later received a cheque in the post. My husband had also successfully carried out the same action a month previously on 2 of his accounts with A&L, but I got a letter today informing me that they are closing my account only.
When I challenged the decision I was told that the bank has the right to decide who it wants to deal with and they no longer wanted to deal with me.
So, I have written back and will raise a complaint with the Financial Ombudsman when they close the account. I am still glad I did it though,
I got a great deal of satisfaction. It is nice to know that they aren't having it all their own way, and the amounts they are paying out are really a very little dent in the millions they make each day.0 -

SENT STANDARD LETTERS FROM THIS SITE (MANY THANX), GOT A RESPONSE SAYING THAT A LETTER OFFERING THE FULL £256 WOULD BE SENT OUT IN THE NEXT 8 WEEKS. THE WAY I LOOKED AT WAS THAT THEY DONT TAKE 8 WEEKS TO CHARGE YOU WHY SHOULD I WAIT 8 WEEKS FOR AN OFFER, PROCEEDED TO MCOL STAGE AND THEN WITHOUT WARNING A CHEQUE FOR THE FULL AMOUNT INC INT AND COSTS ARRIVED THIS WEEK. JUST TO LET ALL THOSE CLAIMING AGAINST NATWEST KNOW...THE 08000154212 NUMBER IS ABOUT AS MUCH USE AS A HANDBRAKE ON A CANOE, FILL YOU WITH YADAA YADAA YADAA ABOUT F.O.S THIS LEGAL TIMES THAT, THE BEST NUMBER I FOUND WAS THE 08453030456. PEOLPE THERE SEEM A LOT MORE HELPFUL
