    sent out second letter today, they say they owe me nothing as account was sent to debt collector and i got a settlement with them for £32 less than debt was originally??? can i still claim???

    They took a while to send me copies of bank statements, but once I had them, and sent them the letter asking for my charges back, they paid up the charges, not the interest within a week.

    This site is the most useful site I've come across, thank you, I'll be looking at more of your articles from now on.

    The story:Sent first letter requesting charges back. Had not heard anything after four weeks so sent a reminder letter and the responded after 5 days with a goodwill gesture of £348 saying that if I did not accept paying further charges to my account then they would have to reconsider if they wanted to offer me an account anymore.

    I originally wrote to them politely pointing out that the charges were an unfair contract and got short shrift. I then sent off my £10 statutory fee and asked for details of all charges applied. After 4 weeks, I rang asking when they were going to reply. They said no letter had been received, rather pointlessly, as they had cashed my cheque. Data followed shortly after I mentioned this! I filled in the form provided by the Financial Ombudsman and got my money, plus some I'd forgotten about, around a month later. Not a lot, maybe, but it's a lot to me!

  • Hi all,
    I claimed on the 12th February after receiving my statements. Got the 8 weeks letter, on the very last day got an offer a little short of what I asked for. They said if I wasnt going to accept to ring them, which I did . After a bit of waffle by him , I agreed that a fiver per charge was fair . They say money in my account within 14 days , dont have to sign anything. :T :money:

    Amount Received £303 - Whoopee!!!

    9/03/2007 - Sent first letter requesting they pay me back the unlawful charges.

    23/03/2007 - Received letter from Halifax saying they would look into it within the next 8 weeks.

    26/03/2007 - Sent letter requesting payment or court action.

    14/04/2007 - Received letter from Halifax saying they will put the full £303 back into my bank account within the next 14 days. RESULT!!! :money: :T :beer:

    Story:
    Started the letters on 1 February, Cap1 wrote back telling us to get stuffed. Second letter remained unanswered so filed moneyclaim on 5 March. Beginning of April we received a shirty letter dated 29 March saying that their terms and conditions are lawful and we would not have a leg to stand on in court but "without the need for a court hearing" ... "as a goodwill gesture" blablah... they had arranged for a cheque to be sent out to us for the full amount. They also asked us to discontinue our claim immediately "to avoid wasting any further valuable court time", even though the cheque was not attached and should be getting to us "within 14 working days". And on the basis of that they put a defence in at the last minute, simply to bide time. Laughable, really. Naturally, we held out, and Saturday 14 April the cheque finally surfaced. It will be paid in on Monday and only THEN will we send back the form to the court.

    Everyone out there - hold your nerves, they WILL cave in in the end!

    This is the second victory we have had due to this website (first was a mortgage repayment fee). Next up is Lloyds TSB - be afraid. Be very afraid! :)

    The story:
    Wrote the initial letter demanding the payment. They sent a letter offering £100 as a goodwill payment.
    I wrote the second letter, declining the offer.
    They wrote back with full settlement. Money was in my account in 2 weeks of making the initial claim.

    Having recieved my bank statements within 35 days of requesting them, I sent a letter on the 11th of April requesting the full amount of £2358 within 14 days. I recieved a 'full and final settlement' figure of £1,585 on the 12th of April, I phoned this morning to decline the offer and inform the bank I would be proceeding with the process. The customer relations officer was very pleasant and asked what I deemed to be a reasonable settlement, I replied that the full amount would be reasonable and she simply asked if I would 'meet half way' :rolleyes: . I had already anticipated this to an extent and therefore replied that I would be willing to settle this with a payment of £2000. The lady accepted this without question and agreed to pay the remainder into my account, followed by a confirmation letter.

    I would like to encourage anyone considering this to go for it, it's a very simple process, which took me only a matter of days and a very small amount of effort. This site has been invaluable as a resource and I thank Martin and everyone who has given feedback on the forums for helping clarify the process, now go get your money back and don't delay a moment longer!!
