    Firstly a huge thank-you to Martin, I would'nt of known about this had I not come onto your website. I took a different approach to claiming and used a third party to do it on my behalf as I simply don't have the time to deal with this. I used John Chambers Financial Recovery Tel: 02083928776 and they where great. It took around a month and a half and victory. I agreed to a 25% of claim fee which I thought was fair considering I did'nt have to deal with the bank at all.

    All I can say is thanks for all the advice everyone on this site has given, and I would encourage anyone to claim now its your money.

    I am a new member to the forums, and was so pleased with my claim result i wanted to tell everyone of my sucess!

    Once i got my statements through, i wrote to Halifax on 9th March requesting payment inclusive of interest. 7 days later i got their '8 weeks timescale for complaint' letter ,so on the 15th day i wrote threatening court action (plus a request for further charges added onto my account since-the above figure INCLUDED these further charges!!) That letter was dated 24th March and on 4th April i received a letter offering full amount (without the interest), which got paid into my account yesterday. What a result! I followed Martins process step-by-step! Its easy-peasy....GOOD LUCK!:rotfl:

    Dear Martin,

    We took your advice and sent a letter to Abbey with the hope of reclaiming £105.00 from our Daughters current account. Guess what?, they paid us £74.00 back, without even going to the small claims court. I thought that was a fair offer, and they didnt even close her account. So another small victory for the the war againts unfair charging. Thanks very much for your advice.

    The story: I'd heard about reclaiming bank charges so thought I'd give it s go with my credit card. Sent of for the statements with a cheque for £10.00, Recieved the statements about 3-4 weeks after the letter had been sent, and they even returned the cheque and said I could have the statements free as a gesture of goodwill. I then used the template letter on this site and sent off a letter, by recorded delivery, asking for the over limit and late payment fees to be refunded to me. Three days later(today saturday 14th April) I got a letter stating that they were quite with in their rights to charge me these penalties but, as a one off, gesture of goodwill they have offered me half of the money £743.00!! I'm not 100% sure what to do now, I think I should accept this offer, but there's a little part of me that wants to try for the whole lot. :)

    Clydesdale Bank:
    I'm still waiting for the Clydesdale bank to send through my statements, they sent me a letter telling me that although their 40 days were almost up they have still not completed my request for statements and that I could contact the Information commisioner if I wished. I'm going to phone them next week to see where the statements are as they cashed my cheque with in days of me posting it. I'll let you know what happens.

    Well I'm sorry to say that I accepted the £743.00 they offered as I really need the cash right now. But on the up side it's £743 I thought I'd never see again. :)

    3 letters sent and Ombudsman had to get involved too but got the lot back and wiped out the rest of the balance i was paying off, also left me £475.00 in profit - nice new PC on the way for my efforts and not on bloody credit too!!!

    Refunded £190.00 (Cap 1 error) cleared balance of £190.00 from card.

    1 letter sent.

    Currently Pusuing:

    Sent letter to Barclaycard credit card claiming £195.00.

    Awaiting statements from Barclays Bank current account (should be substantial as the 40 days are well up).

    Awaiting statements from Nationwide.

    Good luck everyone - keep going - dont get down by the delaying tactics - it will work !!!

    This forum can help alot, just spend some time reading everyones posts, there is bound to be something similar to your situation!

    I sent a letter threatening legal action if not reimbursed in 14 days. Their reply says that they have reimbursed me 'considering my situation' and that any future charges 'will stand', as if they can make this sort of robbery legal just by saying so. I'm delighted it was so easy, and will definitely fight back more in future.

    Sent 1st letter on 5/2/07 asking for the above, after many phone calls to Shenley Rd, customer care team received my letter today out of the blue offering full amount.

    Went as far as MCOL, they paid up 2 days before they had to defend.
