    Story: I sent a letter to RBS asking for my last 6 years bank statements, they sent a letter back saying they'd send them and that they were sorry that i was unhappy with my bank account. I waited, and waited and waited and still no statements turned up even though i called them a few times.

    Then, i received a letter from RBS offering me a settlement figure of £1060, which was very nice of them seeming as i hadn't even seen my bank statements let alone demanded any money off them!

    Anyway, eventually got my statements and as it was only a couple of hundred quid less than the amount i'd beemn charged, i accepted the settlement offer.

    Easy peasey really!

    Wrote to them asking for the 3 x 15 charges to be refunded and politiley got told where to go. Ohoned them and spoke to some snotty little soandso who basically was stupid enough to try and tell me that the amounts werent charges but penalty fees...doh poorgirl Aaafter lengthy discussion on the legality of it all i ended the conversation with are you giving me my money back or not to which they replied NO. Iwas hen told after threatening court proceedings "take us to court we will win". This was ironic as this morning i recieved acheque for the full amount inclusive of interest and court fees. mmm must learn not to fight the big companies again as they are completely in control of these ban charge cases. I cannot thank enough all those that give me and many others the confidence to take on these corporate bully boys. Your selfless time and advise is appreciated by many.

    Sent the standard letter - thank you ;) Two days after, they telephoned me to say that they would be depositing the full amount in my account that day and confirmed that this was their final payment.
  • Wrote to them on 2 April 2007, requesting £1650 to be repaid, had offer letter dated 11 April for £1410 whcih I am accepting.

    First charge on this account, and the guy I spoke to refunded the charges. I currently have no overdraft on the account, but after speaking to him I'll send in an application.

    History of claim - had statements so straight to asking for refund

    Letter 1 16/3/07 - claiming refund of £415 in charges from a closed account.

    Reply from First Direct 23/3 offering £340 (knocked off two random charges)

    Letter 2 - 24/3/07 - declined offer and asked for full amount and made this letter LBA

    Today 13/4/07 - about to issue claim on MCOL, but rang first direct(08456 100 100) before issuing, at about 4.30 p.m. I was very polite, but explained that I was about to issue my online claim. They put me on hold for five minutes, whilst 'the relevant person in another department was reviewing my claim'. they came back and offered the full £415 of charges. I will have a letter in the post tonight.

    I would have had a claim for £66.33 in interest had I gone to court, but this has saved me a lot of worry and heartache and as I have another 7 claims on the go, one off the list is useful.

    I hope this scenario is useful to others, as a possible way forward and maybe it says something about First Direct's tactics at present and their lack of desire to go to Court.

    Hi just a bit of extra news - today (17/4/07) received letter offering the £415 with standard form to sign. I have no other accounts with First direct so was happy to sign, but offer form said that any amendments would make the form null and void. It does not affect me, but I know others have been amending partial offer forms to say accepting without prejudice etc. - and it appears this tactic has been noted and FD, at least, have taken some action.

    Reclaimed £4700 from lloyds tsb:j cost £120 to start the claim in court, lloyds launched a defence but before we'd sent the court questionnaire along with another £100 they credited our account with the money- now doing the same to alliance and leicester!:j :j :T :rotfl: :j

    Thanks for the advice and support. It took from 22nd Feb (writing for statements), 1st claim letter sent 1st April, letter today offeing £415 without prejudice -

    The story:
    I already had the bank statements I needed so I sent the first letter asking for £422 (the actual amount they took from me). They declined saying the charges are fair and legal ... however they credited a £50 goodwill gesture to my account. I accepted this as part payment only and informed them that I would be persuing the rest. So I sent a letter before action, asking for the amount with interest this time, coming to £467.17. Again they declined so I filed a claim with MCOL and received an offer of 50% just before the allocation questionnaire was due back. I wrote back to decline their offer but said that I would accept a settlement of £350 plus court fee (£50). I received the cheque for £400 a few days ago! So all in all I've received more than they took from me in the first place! Result!

    Good luck to everyone claiming, don't give up! The banks don't have a leg to stand on!

    Started claim in Feb 07, got usual fob off letters, started MCOL in March 07 which Nationwide decided to defend at the last minute. On Friday 13th April!!!!! got two letters in the post one from the court to say the case was being transferred to local court and one from NATIONWIDE TO SAY THEY WERE PAYING THE FULL AMOUNT INCLUDING INTEREST AND COSTS IN TO MY ACCOUNT.
