    The Story: They took it to the wire 5 letters received from them during the process. They said they would defend after I used MCOL. Then with a week before court another letter saying the charged are to be refunded!

    Keep going and ignore their letters.

    The Story: Yay! me on the success thread :dance:

    Having gone through online statement I noticed a solitary charge lurking unclaimed from 2006. The only other charge I have ever had I got refunded straight away via email so I thought I would try this route again. I stated the Social Security Administrations Act which states it is illegal to place any charge on an income related benefit. Initially it was rejected, the law denied (they say it doesnt mean bank charges pffft ) and the staff member directed me to the online petition against bank charges and from benefits here : http://petitions.pm.gov.uk/Penaltycharges/

    This prompted another email from me with 'discussion of my options' as I was also protected in this instance by the Direct Debit Guarantee and ultimately I had the option of court proceedings. It was quite fun actually to debate and the staff member is actually a sweetheart to deal with and intelligent. After this further email from me my charge was refunded as a 'Goodwill Gesture'.

    Small victory but sweet and thanks to Martin for the site and all the information I have been able to gather these last few months :kisses3:

    I initially went through the letter writting stage to reclaim just £30 back in October but got the fob-off letters from the bank. I then decided to bid my time (basically too busy at work) but I was charged this month for a !!!!-up (I had funds in my on-line account but the bank refuted that the cheque had cleared and didn't make a bill payment). Anyway, spent 40 mins on the phone to be told they wont refund my £35 charge. I then phoned back quoting a letter they had sent in October stating that if a customer does not go overdrawn within 12 months, they would not usually charge an excess fee and could they refund a previous overdraft excess fee? I hadn't been overdrawn, so the refunded that charge (£30 better off) and as a gesture of good will they will not charge me £35 for the !!!!-up. So technically £65 better of! And I now no-longer have to go through the legal procedings - which by the way I threatened to after my first phone call - maybe that's because of what MSE is doing is really putting pressure on the banks - Good work and thanks MSE. if anyone else is in a similar situation for reclaiming small ammounts it may a good idea to just give the bank a call and be persistant. Phone back, threaten legal procedings etc etc...Good luck to all.

    thank you soooo much all i did was ask for the money they replied looking into it checked my account today and the money was there!!!! i know its not the full amount but its its now in my account and not theirs thanks again i couldn't of done it without your help

    I put in a claim with Egg for £160. Having read the posts about egg I was concerned as I am on a DMP and my egg account has been moved to a DCA. I was so concerned that I almost accepted their first offer of £30!

    Decided that £30 was going to achieve anything in paying my debts off so sent a no thank you and LBA. Today I have received an offer for the full £160!!! :j

  • First Direct charged me £1,600c in charged over the past 6 years... at one point, an over draft charge of £25 was applied, taking me over the limit. next day they charged £100 to the account for being over drawn thanks to their charge! Ridiculous!!!

    Claimed back £1,400 with no hassle at all. Took 15 minutes to tot up the numbers, 2 minutes to write, print and send the letter. They sent a "We're looking into it..." message two weeks later, was offered £1,400.

    Thank you Martin for all the help. You're a national hero!!

    Amount Refunded: £294 (80%roughly) in Bank on 6th April

    I know I should and could have pushed for the full amount, but with taking my son away at the end of this month, I had a choice, skint holiday or spending money that wasn't foreseen back in Feb when I had to give up work.

    Hi,

    Cahoot settled in full 2 weeks before the court date. £680. This covered the charges, court fees and ALL interest.

    Very happy. A big thanks to Martin and the team.

    Amount claimed - £2306 charges + £663.34 interest + £120 MCOL fee.

    Amount received - The lot! £3090.34

    First letter sent 1/3/07 requesting statements. Received them 2 days later (no fee)

    Sent off 2nd letter (requesting my money back) 5/5/07

    A week later I had the usual "we have 8 weeks to investigate" letter.

    22/3/07 - got bored with waiting and just started the MCOL claim against them for the full amount plus interest.

    Halifax acknowledged the claim after 10 days stating their intention to defend the claim.

    11/4/07 - the following letter was received:-

    "I have received and have been dealing with the procedings which you have issued against Halifax PLC.

    Your claim relates to bank charges debited from your current account. These charges were debited from your account in accordance with the terms and conditions which you agreed to accept and by which you are bound.

    I have returned the form of acknowledgement of service to the Northampton County Court indicating that Halifax intends to defend your claim. However, on a purely commercial basis, it will cost Halifax money to defend your claim in terms of legal costs that will be incurred. It is unlikely that Halifax will be able to recover these costs (even if the bank wins) because your claim will probably be allocated to the small claims track, in which costs are not generally awarded.

    For this reason, but without admission of liability, Halifax is willing to reimburse £2306 in respect of the bank charges incurred, together with £664.34 in respect of approximate interest that Halifax has calculated was charged on your account as a result of charges. The Halifax will also reimburse £120 in respect of the court fee.

    This amounts to £3090.34 which will be paid into your account within 5 working days"



    What can I say?? What a perfect result on this one.

    6 weeks from start to finish and all it cost was £2 in recorded delivery fees.

    I would advise ANYONE who has been charged to get in their claim. It's easy and you are certain to win. Don't accept any 'offers', just take them to court and get the lot back including interest.
