    Hi All

A little post to cheer up anyone feeling worried or anxious about NATIONWIDE.

We started our claim on 15th January for £1,548.00, we luckily had all our bank statements.

We went all the way, using all the templates and filing a claim for £1,548.00 plus £123.84 interest and £120 court costs.

As seems usual they said they'd defend the claim in full, which gave them the 28 days. We also had a series of letters saying they were looking into the claim and mentioning the FOS.

On the day we were going to do the Judgement by Default bit,

7/4 we recieved a letter saying they were going to refund the charges.

Today originally claimed money (£1,548.00) has gone into the account under two payments, but no interest or court costs.

We're making out minds up whether to claim back the £120 court costs at least and still haven't cancelled the court case yet.

My point in wrting this post is to stay positive. We got very nervous and worried during the whole process as neither of us have ever been near a court. I kept reading the posts on this excellent site and thinking nothing ventured, nothing gained.

GO FOR IT, THEY ARE PAYING UP.

    Amount Claimed: £1500 + £200 interest + £120 court fees TOTAL - £1820

    Amount Paid: £1800

    Story:
3rd March - Letter one sent (from this site!), adapted slightly as i was a "late comer" to reclaiming and didnt want the OFT's report to come out before i got my money back, so i could go straight to issuing court papers, without going to letter 2!
12th March - Recieved standard "we are looking into it letter"
18th March - Issued court papers on MCOL.
25th March - Received letter offering £1100 and advising if i "wasnt happy" to call. I did and was offered £1500, ie my charges without interest or a refund on court fees. REJECTED advising i wanted interest on MY money. She said "well if you're not going to take any responsibilty for your charges, you'll have to take us to court!" i larfed and said "I ALREADY AM!!!!" HUNG UP.
3rd April - Halifax acknowledged court proceedings
10th April (TODAY) - received £1800 in my account. No letter or phone call. i have no intention of canceling the court proceedings as the £1800 is £20 short, not including the extra interest from me issuing court papers to today. Hopefully i'll still get my day in court!!!

THANKS TO EVERYONE ON HERE, i would have accepted the £1400 if i hadnt read all the excellent stories. People PLEASE dont accept a penny less than you are owed, it'll only take another couple of weeks and this money is YOURS not the banks. I dont care if it's £50 less than you asked for, DONT ACCEPT IT. If you dropped £50, you'd stop and pick it up wouldnt you?????

    Kind regards, Mark (kwakikid)

    Paid Out £930 :D  :D

WOW! I only had to send letters 1 and 2 and they folded like a cheap suit! Thank you Martin for all you help.

If any of you are thinking "Can't be bothered" DONT! Why let them get away with it when so many of us are fighting back and winning for a change!!!

    Bank: Halifax
Amount claimed: £3,270 (but I'd miscounted and it should have been £3,205!)
    Amount received: £3,205

It took me 3 and a half months to get my statements as I didn't know about this site then and Halifax kept stalling - they sent 6 separate copies of 2004 to date but seemed incapable of sending the 2002 - 2004 ones!

Once I finally got the statements - and found this site - it was pretty plain sailing. Sent the first reclaim letter and got no response inside 14 days - phoned up and they gave me the "we are allowed up to 8 weeks" spiel.

Send the 2nd letter threatening court action and 2 days later received a phone call from a guy at halifax offering to settle.

He was a bit devious: "Obviously we could just wait for the OFT ruling which would mean you wouldn't be entitled to the full amount so let's come to a compromise. We won't pay the full amount but how much would you settle for?".

I told him that the amount wasn't negotiable and if they didn't pay the whole thing they'd be looking at interest and court fees on top.

20 seconds later he had got the offer for the full amount authorised. Received written confirmation 2 days later, and the money in my account about 2 weeks after that.

This has been hugely important for me. I avoided paying off a lot of debt as a student and it's only in the last couple of years that I've started to pay it all back (at a horrific monthly amount). Now, with this payout I've been able to clear all my remaining debts.

Thanks so much to Martin and everyone on this site who gave help and advice. I know of at least 5 people who have started their claims as a result of me getting this money back which made them actually believe it can happen.

I've now started on my credit card charges!
  • Hi
Just to let you know I have just checked my Nationwide account and had a nice surprise to say the least.

Nationwide - I claimed for £2288 and got back £2180, no letter to close my account or that they were paying me back. Did take about 8 weeks from start to finish, did everything by the book, got as far as just about doing a judgment online.

Just goes to show you they push you all the way and it can seem like forever.

Good luck to all you who are going through the same motion, my advice is dont give up although you may feel like it somtimes - you WILL get your money back.

    Thanks Martin

    Amout Claimed £1139.00 + £178.15 Interest + £120.00 Court Costs
    Amount Recieved £1271.00

Sent a letter asking for my charges back, got a response saying it will take 8 weeks to investigate. Sent another letter threatening court action, got no reply. Proceeded with court action and recieved an offer of £895.

Rang them up to turn down the offer and they said my actual charges were £1271 not the £1139 i thoughy. they offered to refund this and i have accepted the offer. Money should be recieved within 7 days.

Banks try to put you off but they always cave in eventually.
  • I also managed to reclaim £1300 for a friend from RBOS - It shows it can be done - HAPPY SUMMER B-)
  • bank- halifax
