Story:
Strarted claim 22/01/07 got GOGW £2416 14/02/07 ignored abbey, it used part of it £400 to fund moneyclaim they had until 10/04/07 before the balliffs as I won on default no response from abbey. They sent me a cheque for £15553.09 yesterday I will cancel court action when it cashes I don't trust abbey.

Claimed: £1,360 + £249.24 interest + £120 MCOL costs = £1,729.24
Got: Only the whole flippin lot!!! (£1,729.24) Woo Hoo!!!
Read lots of posts here and found out that Nationwide seem to play hardball, so expected to take it all the way - but here is how it happened:
Sent Data Protection Request (& £10 cheque) on 11th Jan requesting a list of all my charges for the last 6 years.
Received a big pile of statements about 2 weeks later. Went through them and calculated the charges plus interest using Martin's Interest Calculator.
Sent letter 2 about the middle of Feb asking for my money back. Got the standard letter back within about a week saying NO WAY, the charges are legal, it's in the T's & C's that you accepted etc... Blah Blah...
Decided not to bother with Letter 3 threatening court action as I knew that it would end up there anyway - and doing that would just waste time!
So, filed a claim with MCOL on 26th Feb - which was deemed 'served' on 2nd March, and Nationwide 'Acknowledged' the claim on 2nd March, so they then had 28 days to file a defence, which took it up to TODAY (30th March).
Yesterday, I received a letter from Nationwide saying that they will pay the whole lot - including interest and Court costs! Checked my account and yep, the money is all there! So, no need to proceed with the court allocation!
They haven't said they will close my account, although I have already opened another account and have moved everything into the new account just in case!!!
Anyone out there worried about doing this? DON'T BE!
If you're with Nationwide, you WILL have to take them to court, BUT it will NOT get to a trial. They WILL pay out - without admitting any liability of course ;-)

This is just to report that we where payed out £2245 from Halifax after just sending the first letter, we used the template shown on this site and after just 4 weeks where sent a letter confirming refund.
They didn't close out account.
I would like to thank money expert for making this stand easy. Everyone sholu fight back....

On 26 February I wrote to First Direct (enclosing £10) asking for a list of the charges. (I closed my account with them about 2 years ago).They returned the £10 as they do not charge and sent me copies of bank statements for the past 6 years. On the 19th March I wrote to them (using Martin's template letter) asking for £961.50 charges to be refunded. On the 29th March, 2007 I received a letter offering £815. I accepted this as the FSA's ruling was due this month - I was afraid to challenge them further because if the FSA ruled that £12 was the correct charge I would only be liable to £700 of refunded charges. I had charges of £50 applied to my A & L account, one in August 06 & one recently. Both had been a genuine error on my part as I had paid the money in on the same day that money went out (they don't give you a 24hour window before they charge now).
I wrote to them using the 1st template on Martin's fantastic website (!) (without claiming interest) & included a breakdown of the charges on another sheet of paper.
Less than a week later, I have recieved a letter from them stating that as a "gesture of goodwill" they have made arrangements to "refund £50 in the respect of the charges raised"
So amount claimed has been paid, plus they have not closed my account either. Anyone thinking of trying to re-claim charges, no matter how small, I say GO FOR IT!!!

Hi, this is the first time I have wrote on this website, but felt compelled too. Without the fantastic help and success stories on here I would never have had the guts to take on the Halifax.
Anyway quick timeline of events.
Sent 1st letter 28th February asking for £1857.75 (charges plus interest)
Got the standard 8 weeks to respond blah blah letter
Sent 2nd letter 12th March, got response yesterday (letter dated 27th) offering me £1848.00 A fantastic result for sending off 2 letters.
Thank you to everyone on this site and to Martin for a stupendous website. Makes you realise the big companies cannot intimidate the masses anymore.
My advice to anyone who is unsure whether to claim charges back is JUST DO IT!!!! If I can do it anyone can.

Hi My eldest son got his written offer which he accepted this morning after
2nd letter. Process for reclaiming only started end of Feb but got offer of £1300 today. Other son with Abbey and they are stalling. Court claim being submitted tomorrow.

All the usual letters sent, Moneyclaim filed - the end of their 28 days was due next Tues. Received a letter today saying that they'd repay it all.
Checked my account - it was all there ! ! ! :beer:
For the sake of a few letters, and a little homework, it's well worth it.
Surprise, surprise - they didn't even close my account. They did say that if I incur any penalties in the future they will close the account. No problem, because I will be closing it when the money has been withdrawn.0 -

Success I have reclaimed my charges £3000, now the flak has hit the fan,but not for the first time Halifax yesterday bounced a cheque. Previously they had bounced direct debits since my refund but I got them back. So I got an the hoof yet again and spoke to the man eye to eye.
Sorry but why have you bounced the cheque not enough funds . I said sorry wrong answer there is enough showed him the Internet banking recent transactions. Showing the updated balance. Er well it must have been processed during the night. Oh so were you here, my PC doesn't accept cash so you must have been closed.
Any way you have just received a large amount of bank charges back from us so we will not be refunding the charge. Time to close the account, not before claiming the bank charge refund. All in agreement.

Story:I disputed a single incident where I'd been charged £34 for a failed standing order a few weeks ago. I generally have a good credit balance, but it happened that I had miscalculated the date a large transer in would arrive, and also a debit card payment to an ISA I was still in the process of setting up got taken sooner than expected. I wrote on Thursday last week, and on Saturday the money was credited back to me. A letter followed stating that this was a goodwill gesture but that the charge was correct and legal, and would be applied in future.0
