    thanks Martin! i sent my first letter off claiming the charges in November and went right through to filing the court allocation late January. received 6 offers in the meantime from hsbc and their solicitors, all between 60 - 80% of the total. not good enough! so 2 weeks ago i finally responded to one of these offers using wording from a letter someone had posted on the CAG forum. said i would accept their offer as part payment of the total and basically that they could stuff their gagging order as i reserve my right to tell everyone about the whole fiasco. today i received their response offering the full amount! and they also said i could strike out the non disclosure clause from the agreement before signing if i wanted to! nice of them ;)

    seeing as i didn't ask for an overdraft to be put on my account when i opened it 2 years back, and have since wrestled with call centre staff to get it removed, i see this as sweet consumer revenge. don't lose nerve - if you're willing to wait, you'll get all your money back!

    now i'm going to help my boyf claim his £5000 worth of charges - yeh! (shakes fist angrily)

    Was happy to receive that amount,
    this was from a Business account,
    I sent off the first letter,by recorded delivery,
    I enclosed a full list of charges plus interest,
    although I had my bank statements,I did not enclose them.
    It did take about 7 weeks from start to finish.Not long.
    We have now closed our a/c,
    I had been with that same bank for over 40 years,when it was called
    Midland Bank.
    They are not interested in loyalty,only what they can get out of you Im afraid.
    So a very Happy Bunny.
    I now have another a/c which I am pursuing.

    Wrote 1st & 2nd letters got standard reply, waited, and waited got another sorry not dealt with yet letter, issued court proceedings offer received the next day! Accepted and will stop court action when they open. This was a safety net incase they didn't pay up in timelimits specified!

    Wrote first letter 20th February asking for money with a spreadsheet of charges which I downloaded from the online banking site
    no reply.......
    Sent second letter 6th March, again with the charges breakdown
    received an acknowledgement to the second letter on the 16th March. Rang them on the 19th March and told them it wasn't a good enough response. They assured me they were endeavouring to complete cases within 6 weeks so hung on a bit longer.
    Rang them again 26th March as still no word and said they couldn;t tell me of any progress. Rang again 27th and found out they didn't have my 20th February letter scanned in so went on Royal Mail site and printed off the signed proof of delivery and faxed that and a copy of the letter to them.
    Wednesday 28th (just one day later) received an offer letter for £2,633!! :money: Thanks Martin, you deserve a knighthood for your work!!!

    Amount refunded £2245.60 +interest+costs

    This was a bit protracted but still easy using the letter templates. After 1st letter got a reply saying how sorry they were !! but no refund. Didn't reply at all to 2nd letter. Launched MCOL and they immediately refunded £680 as a gesture of goodwill. They then said that they would defend the claim so I had to wait another 28 days (somewhat nervously). They didn't defend the claim so the judgement was by default. Even after that Lloyds dragged their heels and I issued a warrant to send in the bailiffs. That worked and the money was credited to my account.

    Anyone still dithering - stop and go for it!
  • Wrote the 3 letters from Martin's site starting in January 07. Filed MCOL 28 days ago. Almost ready to go to court when letter arrived offering full amount but crediting half of it onto card. Not acceptable to me. Phoned today and said i wanted the whole £481 in a cheque. they said that they usually clear off the debt on the card to take it to zero, paying themselves with my money no less. they have agreed to send cheque instead for £481.
    Thanks to this site i couldn't have done it without Martin's letters and everyone's success stories.

    Account 2: Reclaimed £786.54 Received: £791.16


    Yes - A/L took ages to process application
    Yes - They waited until I took them to court
    But - Paid up within 2 weeks
    Yes - Are closing both these accounts.

  • I just want to say THANK YOU!!!!! to Martin. I have just been repaid £1170 bank charges from Barclays at the first attempt.
    I have also saved money on life and home insurance.

    Story:
    Started getting copies of bank statements in Dec 06. Was offerred £185 within 2 weeks of requesting refund on charges. I hung in there threatened court.... got a court date.... 1 week before the hearing the offered my a total of £531.28 - SUCCESS!
