    Hi People,

    Reading alot of the comments it seems Halifax are the biggest culprits in this i had a claim with RBS and the full thing was resolved in 5 weeks with full payment, anyway i need answers to a few questions please

    1. What is MCOL ?
    2. How do i start a court claim from scotland online
    3. I am still awaiting missing 2 years of statements and its way past the 40 days and everytime i try to contact information commisioner its always engaged. I advised the Halifax i was going to do this and they said that was up to me.

    I know i have been advised on the missing statements before but i need to know how much it is before raising a court claim.

    How quickly will the Information Commisioner be if i raise a complaint as the Halifax has already raised my complaint even though i am missing 2 years of statements and the 8 weeks runs out on the 16th April.

I know you are not allowed to charge them for this so it may be they do this in the hope that you will ask for it back and they can stall the process further by writing back to you again to tell you.

    Any help would be much appreciated.

    Older details are archived on microfiche and they must represent it for you in comprehensive and readable form. The ICO has said this is a relevant filing system for the purposes of supplying details under the Data Protection Act so you are within your rights to ask for this to be sent within the original 40 day time period. Any extension of this is at your own discretion and subject to complaint to the ICO if they delay deliberately.

    To clarify the interest issue a little. You can claim 8% statutory interest on each charge, in overdraft or not, and use the calculator in the main article to work this out.

    You cannot claim interest on an overdraft where the overdraft was incurred by you. You can if the overdraft was incurred by their charge and consists wholly of spiralled charges.

    The difficulty is that where their charge takes you into overdraft but you also continue to draw on the overdraft. Then you are both responsible for the interest. The relevant interest that you can claim under these circumstances would be so difficult to work out that frankly I wouldnt bother.

  • Sorry folks next question.....
    I am about to send LBA but as I have now accepted partial payment not sure about how to list the charges and interest as part of the original amount has now been paid. Also what about updating the interest? Should I just not send list of charges this time as they were sent this with my original letter and work things out accurately if it gets to court claim stage?
  • in general when sending LBA should you send list of charges with interest updated to date or just a copy of what you sent with first letter to reclaim

    Thanks for that, i have always felt that Lloydstsb were not to bad with the charges compared with the Clydesdale, the charges i incurred with them were horrendous but unfortunately that was over ten years ago so have lost that one, another question i have is do you send the letter to the local branch or to the head office of the bank and do you go for the interest or just settle for the actual amount.

  • Hi I am not quite sure how to go about claiming all the charges from my bank the halifax from the past 6 years I know that there are some but I don't know what i can claim and how much of them i can claim.
    I lost my business in 2004 and had a halifax bank account halifax credit card and also a barclaycard. in 2 years I recokon I had £2000 pounds of charges maybe more from the halifax credit card and in 3 years I have had £1000 from the barcalycard I stopped using my halifax bank account because even though I have an arrangement to pay my credit card off at £40 a month everytime I get any money in the account they take it to clear my credit card off.
    I haven't got a clue on what charges i have paid on my account but could really use some help on what i can claim. I think I have all my bank statement from when i opened my account but don't have any of my credit card statements. how do I go about getting them.
    My Mission today is to have an opinion on everything.
    If you don't like it well you will just have to lump it!

    Bank = Barclays Bank
    Amount Claimed = £585
    Amount Received = £470 (80%):j

    Only started this at the end of January when I sent off for statements and sent 1st letter requesting money about 4 weeks ago. Just looked at my bank account online this morning and found £470 saying "Goodwill Gesture" next to it. Wasn't expecting so much so soon being Barclays as i've heard they are tough! Really pleased as I was expecting £200 ish and would have accepted that as I really need the money!
