I wrote to Abbey asking for a list of charges on 1st March. I've just received all my statements for 2006 but not for the previous 5 years (quite pleased with the speed of response to be honest).
Has anybody else had theirs in batches?
Also can anybody comment on how quick Abbey normally are at paying out?

I too am with Abbey. They sent me through 1 statement, i called them up and was informed that they would come in dribs and drabs but should receive all within the 40 days. The following day i received a years worth, just a bit of patience as it will be worth it in the end.
I think Abbey are just being difficult, but then it costs them more in postage!!!!0 -

just a quick update and some advice required...filed via MCOL against Monument got the notice of issue yesterday it says it will be deemed to be served on the 28th of March what does that mean ? sorry just not that clued up but want to learn...? it also says the defendant ( Monument ) as until the 11th april to reply if they do repley do MCOL contact me with updates? i am soso scared?? any help would be great ?? Thanksxxx
The court allows 5 days for the claim to be served so 23 + 5 = deemed to be served on 28 March. They have 14 days from then to acknowledge (that is to 11 April), if they don't acknowledge you have won and can apply for judgement by default. If they do acknowlege, that gives them another 14 days (to 25 April) to defend, if they don't defend, you have won and can apply for judgement by default. If they decide to defend you will get an Allocation Questionnaire in the post to fill in and send back, and a court date will be set. This still does not mean that the bank will actually come to the court date. They most likely will settle before. Only very few cases have actually gone in front of a judge, and every time (apart from once I believe where the claimant was not properly prepared) the claimant has won and the bank had to pay up.

advice please! cap1 have credited my account with £136 ( claim was for £400 + interest. when wording LBA I have said I accept £136 in partial payment. Do I then say I intend claiming full amount in court or I intend claiming the remainder of my claim. Just not sure about the wording - sorry for being a bit dense but want to get it right.

I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges+statutory interest+court fee.Reclaimed thanks to this site:

Just to clarify, I don't need to do anything just yet, wait for them to respond - it'll be the 14 days 28/ 3 ...if no resonse send the LBA, making adjustments in claim for amount?
Would I need to explain why the amount I'm requesting has changed at this stage?

Hi I've been reading this site with interest and came across your 'sample letter' and wondered if I could use the same sort of wording in a letter to Llyods. I have already done a moneyclaim on line 12/3/07 received a letter back from Llyods dated 23/3/07 with the usual 'we believe it's fair blah blah but then saying they are prepared to reduce the charges by repaying £750 which they say will be credited to my account. However they haven't ask me to respond to this and they view the case closed!! The amount i'm claiming totals £1486 which includes £120 court fees. Should i ignore their letter,let the money go into my account but continue with claim through the courts or reply to their letter saying i will accept their offer as part payment but will still proceed?? Bit scared of the thought of going all the way but don't want them to get away with it either!!0 -

I am about to send LBA but as I have now accepted partial payment not sure about how to list the charges and interest as part of the original amount has now been paid. Also what about updating the interest? Should I just not send list of charges this time as they were sent this with my original letter and work things out accurately if it gets to court claim stage?0
