    Good morning people !
    just a quick update and some advice required...filed via MCOL against Monument got the notice of issue yesterday it says it will be deemed to be served on the 28th of March what does that mean ? sorry just not that clued up but want to learn...? it also says the defendant ( Monument ) as until the 11th april to reply if they do repley do MCOL contact me with updates? i am soso scared?? any help would be great ?? Thanksxxx

    I got my statement back from Lloyds TSB and sending the 2nd letter to claim back £825.00. I would like to add in this letter that they removed any bad credit score on my files but not being English, I am not sure how to say it the business way.

    Anybody has an idea?

    Hi, I also am in the process of claiming against Abbey. I used the templates and within 14 days I recieved 14 months worth of statements. All in seperate envelopes-and each with a flyer-( i presume we pay for this as well.....lol)
    I then didn't here from them for almost a fortnight so I called them only to be told that the admin dept. don't recieve or take phone calls but they would be e-mailed and told that I was chasing the info. that I had requested and paid for. Hey presto 4 days later a large envelope containing app. 65 pages of what looks like printed rubbish, however if you look down each page Abbey usually take there charges on or arround the 30th of each month.
    It will say "unpaid dd charge" amd in the next collumn "chg" and then the amount.It may say "unpaid s/o charge" as well. ( standing order)

    I hope someone can help.

    I requested my boyfriends statements which he received. Sent a letter on the 12th March requested £1442.53 charges back and the following day checked his latest statement and saw he had a further £176.00 worth of charges, again i sent a letter requesting charges back on the 13th March.

    He has received a response on 21 March offering £176.00 as long as he signs a statement saying he is happy and the matter would now be closed, but has received no response on the orginal letter dated 12 March for the bigger sum be claimed back. If he signs this statement will he then not be entitled to the £1442 back? Or can he accept as part settlement but the other be chased? If so is there a standard letter on the templates saying that he will accept as part settlement?

    I think RBS are being very sly with this and i dont want to mess it up!!!!

    My story: The charges of £626.50 were only for 1 year in 2001, so there was quite abit of interest to be added of £275.26, then court fee of £80.00. We were going through a bad patch then, and these fees only made the situation worse!! In fact, this was towards the end of the bad patch, and I wish that we could claim for more than 6 years, as we had charges in the previous 3 years too!!

    I still had all old statements, so listed & totalled all the default charges.
    16th February - used template letter & interest calculator - sent letter with the list of charges & interest.
    A & L replied - all charges are fair etc. etc......
    27th February - used template letter - sent letter, stating intention to claim through court if no satisfactory response, with another list of charges & interest.
    A & L replied - all charges are fair etc. etc.......
    9th March - filed claim with Money Claim Online, and this was issued to A & L.
    14th March - A & L filed an Acknowledgment of Service, of intention to defend all of the claim.
    24th March - they have not continued with their defence to court - CHEQUE RECEIVED for £981.76!!!!!

    GREAT!!!!! SUCCESS FOR THE LITTLE PEOPLE TAKING ON THE BIG BOYS!!!!!

    I hope this breakdown of my journey encourages others, as other people's stories have helped me. Do stick at it & don't be discouraged & put off by the bank's letters, or going as far as taking your claim to court - it really is easy and straight forward!!

    But - I would not have done it without this site - I have spent ages, before I started my claim & during the process, reading the responses in many of the threads, particularly the main help thread & my specific bank thread. All of the questions that I had, were already asked & answered there, so there was no need for me to post a query.

    To Martin & everyone who has posted & given help, advice and encouragement, & detailed their stories - THANK YOU!!!

    Finally, & most importantly though - AN EVEN BIGGER THANK YOU TO MARTIN - for setting up this site - this site has helped me so much before, & now it has once again!!!! I've been a member since 2003 & haven't posted very much, but I come to it regularly and avidly read the weekly Email & postings in the Chat Forums!! Martin's advice really has helped us to be more financially aware & secure - particularly as we are almost pensioners - we should be old enough to know better & be financially savvy - but you are never too old to learn!!!!

    Learn from the mistakes of others - you won't live long enough to make them all yourself.

    Ammount accepted: 2400

    Sent the first letter to customer services as internal mail and recieved 6 years of statements,provided free of charge as this service is free! Highlighted all the charges which totalled 3195, without interest, and returned the lot with the second letter. Recieved a letter back stating they would sort out my complaint by 20th March. 20th March arrived and no letter so i phoned them to ask where it was. 2 days later it arrived! Carried an offer of 2400 which i have accepted.

    I wrote to Abbey asking for a list of charges on 1st March. I've just received all my statements for 2006 but not for the previous 5 years (quite pleased with the speed of response to be honest).

    Has anybody else had theirs in batches?

    Also can anybody comment on how quick Abbey normally are at paying out?
