Hi there, I don't know if anyone can offer me advice on this one, but I have recently written to my bank requesting charges back of the amount £2200. After 12 days I have still not heard anything and was planning on sending the 3rd letter advising them that I will be taking them to the small claims court but I have just read that in Scotland you can only claim a maximum of £650. We have only lived in Scotland for one year due to my husbands job but the bank we are claiming from is based in England. Could we claim through the small claims and use one of our parents addresses in England for correspondence? If not, is there a way we can claim for the full amount through small claims in Scotland rather than just £650?Current Debt - [strike]£22,635.83[/strike] 13,321.65

I hope that someone can help me on this one!
I sent 2nd letter and on the 13th day received a letter saying bank needed more time so therefore submitted MCOL on 15th day. This all went through on the Friday and low and behold I got offer of £508 basically the charges no interest on the Satureday so I duly completed the form and sent it back in the timescale of 10 working days and they say they will pay within 7 days of receipt.
I've not yet stopped the court action as I think that if the bank don't pay up in time I will continue the court action for full amount is there any reason why I can't?

Hi , just registered today although been on your site every day since January, I am trying to reclaim charges from LLoyds TSB sent my letter requesting statements over 4 weeks ago, since been told LLoyds are a nightmare to reclaim off and will fight all the way.
they have until mar 5th and then another letter will go out asking for statements again.
Hi i've just registered today also, not sure if i'm doing this right to be honest!!! I'm also reclaiming charges from Llyods, who are a nightmare!! I had to go to the court stage paying £120 to do so, that was a week ago, had a letter from llyods today still not admitting they are wrong but offering me £750. My claim was for £1366 plus my £120 court fee, i'm not sure what to do, do i except their offer or go all the way?? They are very crafty with what they offer to be honest...... Trouble is i don't know what happens if i decide to continue??? Any advice would be grately received,

Hi there, well I'd say that if you got to the stage of court action and they haven't covered the costs they charged at least then do nothing and go for the lot as you will get the interest now...0

Thanks for your reply i got a bit lost looking round the site for a second wasn't sure if i was in the right place to chat?? Do you know what happens now though because llyods said in the letter 'the amount will be credited to your account in the next few days' haven't given me time to respond and i'm not sure what i have to do as far as my court action now that they have responded? How do I know if they've entered a defence to the claim or not?? Sorry i'm a bit confused with it all to be honest, not that i want to be greeding claiming the full amount but why should they get away with it!!!!

hi everyone got a response to one of the claims im doing on behalf of my sister she had the statements so i went straight to letter two we got a response on friday saying that the charges were fair and clearly stated in terms and conds so we are going to letter three ive filled the letter out but wht do i put in the court bit is that my local county court i have just registered on mcol0

Hey Suzy, hmm, not sure how far you have got with the whole thing, but if you write back and say not accepting the offer and will continue with court action they likely to maybe make better offer.. Have you claimed online or via your local court, if you done it online at moneyclaim.gov.uk then that will tell you all the info about if they have put in a defence normally the banks acknowledge the claim gives them longer to put in defence but likelihood is they won't or by default they get it in too late.... sorry can't be much more help Alan0 -
I visited the money saving expert site for the first time a few months ago, since then I have used the templates to reclaim my bank charges from the Halifax, I requested £1204.00 and to my joy, after the second letter they lodged £1300.00 in my bank account:T . Just want to say a big thank you to Martin and everyone involved in this website, its great! :j0

When I did mine I just left it as "through the county courts"
they will soon know it done online and because you are an individual it will if it gets that far get sent to your home court..0 -
I remember watchin gmtv and saying 2 my mum you should do that and then when i realised how much my joint account with my ex had been incurring with bank charges i was shocked, the banks kept threatening court action and eventually a default notice was sent to me, and i did contemplate bankruptcy as i thought i had no where else to turn to until one nite i was watching watchdog and people like me who had gone over there overdraft limit and a number appeared on my screen anyway i gave them a phone they said they will deal with everything, well a few weeks later the The royal bank of scotland have settled giving me £2500, thanks:money:0
