    Yes but dont worry too much on that basis alone. Some banks indicate they will defend and sometimes this is to have the effect of delaying resolution and intimidating the claimant. Not all banks actually file a defence. Deal with it if and when they do and good luck :)
  • Hi have received a response from lloyds saying chargers are fair etc etc, so am sending next letter. my question is how do i work how the interest and court charges, to incude in the letter.

    Now you have my brain into overdrive! I've just phoned up Natwest and the end of month charges include penalty charges for going over my overdraft! So some of it is reclaimable! But it is not broken down. So how on earth am I to know what is interest and what is unlawful charges?? Sneaky devils!
    About £300 they know I cannot unknit!

    For my Brother
    Bank: Halifax
    Amount reclaimed: 1340.07(including interest)
    Amount they paid: 1274(cost of charges before interest)

    He has received a letter 4 weeks after we sent the 1st letter as per template with interest to say he will have the charges refunded to his account within 14days.
    Thanks so much to Martin and all who post on this link for enabling this to happen.

    It might simplify it further if you can pinpoint one of their unlawful charges taking you into overdraft. if this is the case then the interest is reclaimable. If it was your own doing then no it isnt. Check month by month to see if thats the case.

    2. Letter 2 - Unfair charges
    3. Letter 3 - Small Claims
    4. Payout

      Payout - £4800

    Yes! I know I didn't get the extra interest, but hey!, not bad for two letters and postage!!

    I received a full list of my charges from Halifax and seny the 2nd template letter in asking for these charges to be refunded to me and they had 14 days to reply.

    I received my reply which stated:

    We are sorry to learn that you are unhappy with the charges debited to your bank account. Please note the complaint handling rules set by our regulator, the Financial Services Authority, gives us 8 weeks to investigate and respond to complaints.

    It then goes on to say that they will respond at the earliest opportunity. However, if not thoroughly investigated in the next 4 weeks they'll write to update me.


    Is this the correct timescale they are stating or is it just a way to prolong the process.
