Could someone please help me?
The 28 days in which Natwest had to respond to my claim for repayment of bank charges expired today, but to my horror I received a defence from them and a request for me to complete a CPR18 by 06 April.
I think they have a damn cheek asking for further info at this late stage when they have had 28 days to request it, yet they are only allowing me 10 days to send them the CPR18.ask me!
Could someone confirm, am I correct in thinking I do not have to complete this unless asked to do so by the judge (my claim is for approx. 4K and should go through the small claims track.
I got this info from site and have therfore compiled the letter to send to cobbetts refusing to submit the cpr18. I have also printed a copy of my refusal to the court along with the letter specifically to the court to advise that cobbetts have requested the cpr18.
WHAT I NEED TO KNOW IS..... As the 28days are up today and they have sent a defence, do I still need to enter a judgment on MCOL, or do I just do nothing now?
I am really pooing my pants at this stage, as I leave the country in about 6 weeks, and am scared it will end up in court and that I will not be here to attend.
Any help would really be fab.

Thankyou for your response alan192 you feel your being listened to!! Your advice has been helpful to me. I went through each stage on martin's site each letter sent and then put in a claim through moneyclaim online that was about a week ago had the letter from Llyods today offering £750 and stating thats their final response and if i'm still unhappy to ask the financial ombudsman to investigate my complaint!!! Funny that i'm not complaining just want my hard earned money back!!! Think i will ring moneyclaim about my case on monday and find out a bit more from them as to where i stand now that i've been offered an amount. Thankyou again for your help and i hope everyone else trying to get charges back from Llyods get it cause they make it hard thats for sure. Suzy0

Hope this is not a daft question but do you send £10 admin fee for each account or each financial institution?
The reason I ask is that I would like to reclaim charges for a Natwest current account and a Natwest visa and a Natwest mastercard. Would that just cost me £10 or £30?Official DFW Nerd Club - Member no. 043 :j

Should you get to the court stage you need to make sure that your claim is then accurate. Meantime I wouldn't worry about it and you can alter your claim if you need to send off the letter before action letter.0 -

This is standard procedure from Lloyds to give a goodwill gesture and you need to reply to them that you will accept it in partial payment and without prejudice but will be continuing with your court claim for the rest of the money plus the interest and your court costs. By all means phone MCOL or email them and let them know you have done this.

Reading alot of the comments it seems Halifax are the biggest culprits in this i had a claim with RBS and the full thing was resolved in 5 weeks with full payment, anyway i need answers to a few questions please
1. What is MCOL ?
2. How do i start a court claim from scotland online
3. I am still awaiting missing 2 years of statements and its way past the 40 days and everytime i try to contact information commisioner its always engaged. I advised the Halifax i was going to do this and they said that was up to me.
I know i have been advised on the missing statements before but i need to know how much it is before raising a court claim.
How quickly will the Information Commisioner be if i raise a complaint as the Halifax has already raised my complaint even though i am missing 2 years of statements and the 8 weeks runs out on the 16th April.

Hi.Can anyone who banks with the rbs help me.I got my statements no problem.However im unsure over this charge.I know i cant request the interest back but every month from november 2005 the bank have on my statements CHG to (the date) £25.00. while at uni i paid £5 for royalties subscription but the rest is a maintenance charge for god knows what.Can anyone clear this up for me.At this stage i dont want to have to ask the bank !0

I first claimed from mint. after first letter was denied, then i threated to take court action . Mint sent a letter very promptly back saying they were currently looking into the situation to see how they could resolve it. After waitin for about a week and a half got a lengthy letter and a check for £84.00 which is what i claimed for in total.
Sent the first letter demanding money back from Capital one £135.00
Got letter back after week and a half offering back £48.00 which i accepted as i thought that was 48 pounds i thought was gone for ever!
Alliance and Leicester played hardball took them to court using moneyclaim
after a week and half i received a letter and check for £545.00.
