    Hiya!

    Just a quick questions - has anyone else reported a bank etc. to the IC yet for not sending statements out within the 40 days?

    I recently reported 4 banks by filling in the online claim form but haven't had an acknowledgement or anything so was just wondering how long it normally take for the IC to get in touch and what happens? :confused:

    I don't understand what the above paragraph means, however, you need your statements/info no matter what you do so send out the letter linked in this thread or even go to your local branch and wait there until someone gets the information for you.

    Not sure if this is true as they took the 2 x £10 postal orders i sent in but they have a telephone number which is 08456 03 79 23, however, this is for the Bank Of Scotland which in a way is in the end Halifax so in a way is HBOS. Try it and see what do you have to lose you may in the end save yourself £10 each statement, however, if you are just looking for a list of Bank Charges then this is only £5 from HBOS.
  • As expected i recieved the defence today from Barclays.
    No1. says I do not provide details or particulars of the precise charges alleged to have been unlawful.
    Well this is total rubbish as they have had all this twice, dates and all details.
    No2. they go on to say the defence is summary in nature and the defendant reserves the right to amend this statement in due course. I imagine that is in there when they decide to settle??
    3.ab&c is a load of waffle about how they have rights to charge "paid referral fees" and administrative fees etc, plus the right to charge if the claiment becomes overdrawn without an overdraft limit.
    4. This says all there charges are laid out clearly and give the claiment a transparent view of all the terms and conditions.
    9. They say the charges and interest are and remain lawful and enforceable and that they were entitled to debit the same.
    10. says there are a few dates prior to 15 Febuary2001 that are not recoverable because they are time barred undr the terms and limitations act 1980. (Fair enough i guess)
    11. Finally they say they have suffered loss and damage as a consequence of such breach of contract because i allowed my account to go into unauthorised overdraft. Oh and then they waffle something about recovering charges from me and not necessarily to be limited to the value of the said charge!!
    Hope someone can take the time to read this hot air and let me know if this is all standard stuff to frighten me away:eek:

  • I received a letter today from rbs refunding my charges of £6320 for charges levied on my business account over the last 5 years!
    I didn't ever believe that i would be so fortunate and was of the belief if it's too good to be true then it isn't! Well in this case i was definetly wrong,Martin you are a saint!!!!
    Perhaps you should be in the government in charge of consumer affairs!
    I think alot of people would vote for you,i certainly would!!!

    My daughter and brother in law have both taken Martins advice (thankyou) and used template letters against Lloyds TSB. Had to proceed to court. Both were paid in full before court date even arranged.
    Lloyds playing games using standard letters and the courts etc etc
    Dont give up.......You will get your money back.

    so i mailed off registered post to abbey national plc letter showing all charges inc interest and giving them 14 days to reply.:rotfl:


    got letter back this morning stating they have one of their team investigating my complaint and will do so in a timely fashion....ME THINKS NOT!!!!:confused:

    so im just drafting up last letter before issue of court papers:money:


    what i need to know is where/how do i find my local county court:rolleyes:

    is it just nearest to my home address in say local telephone directory:rolleyes:


    any info helpful .#

    Don't worry about putting the name of the court in just leave it in the letter as county court ;)

    I submitted my MCOL to HSBC yesterday, what do i do now? How long has the bank got to reply?

  • Hi. I'm new to all this and am just doing my first letters.
    One is to TSB for a current account which we actualy closed last year.
    The other is to the Co-op for a credit card which I also closed recently (two months ago).
    Does anyone know if I stand much (or any) chance with these people. My claim is probably going to be about £600 with TSB and about £300 with the Co-op.

  • Bank : RBS Total 5012 with interest
    22nd Feb 2007 - ordered Statements with cheque for tenner.

    27th Feb - statements arrived.

    1st March - sent 2nd letter requesting charges back.

    6th March - recived letter saying complaint being may take 8 weeks etc etc etc

    14th March - sent 3rd letter saying i would accept 4131, providing money in my account within 14 days.

    21st March (today) - Just recieved letter with full offer of 4131.00.

    What a result, all done in less than a month.
