Personally I think it has no bearing on whether you can claim. If Ikano were the underwriters for Allders then this is who you would direct the reclaim to.

2. closed account and payment demands.
3. default on my credit file.

A look through the success thread shows Abbey do pay out eventually they are stubborn and need kicking along every step of the way so please do persevere. They are one I will be doing battle with eventually and I watch their cases progression with interest.
At what stage are you at in the reclaiming process ? Your second letter should have stated that you would be reclaiming the full amount plus interest and they had 14 days to reply or you would reclaim in court. From there is the court stage.
A tip I saw on the threads is to get the N1 claim form from the local court and complete it but dont file yet. Send a copy to the bank giving a final chance and 7 days to respond and pay in full. If none or unsatisfactory reply then file your copy and go to court. It gives one last kick for them and gets the whole filling out the forms thing out of the way. You then have a chance to breathe, take in exactly what you are doing and prepare mentally for court. This process can get stressy and stress is nasty so take your time and try to be relaxed about it all. Just a tip
The bank charges arent lawful. That alone gives your case for reclaiming all it needs by way of strength. The closed account is a grey area; if excessive charges forced closure then personally I would complain to the Financial Ombudsman. I dont know that compensation would be payable in the same way as it is because they are closing accounts due to bank charge reclaims but it is worth looking into. The default on your credit file is something you can address for removal but it is complicated and I would look for more advice on that.

Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA0 -

My original letter was forwarded to you on the 22 February 2007 together with a cheque for 10 pounds requesting statements for the past 6 years under the Data Protection Act. I received a letter back from you dated the 16 February stating you could not provide the information as you required a cheque. As I believe this to be “delaying” tactics – I did not write back informing that you had already received a cheque but simply returned your letter with yet another cheque attached. The original cheque has now been presented for payment by you.
The 40 days allowed for you to respond to my request has now long since past. I have issued my Money Claim and wonder if the 5 days in which it takes to be served to Lloyds starts from the day that I ussued it? Iissued it on 19/03, so would the 5 days take it to 24/03, and then 14 days added onto this, being 07/04?

Sounds fine to me but dont expect your statements within 3 days, although miracles have happened and people receive them sometimes yours is one of a million complaints on the matter. The awaited OFT report has whacked the hive with the banks delaying until then and claimants getting more and more frustrated and insistent. The sooner it is out of the way the better. It will change nothing for claimants and the banks will just have to accept this and behave and send information when requested.
Complain to the Information Commissioner. They are receiving thousands of complaints and working through them so the whole thing has basically snowballed. It is inevitable that there will be delays. Try and ride it out.
As the original cheque has been presented for payment I would cancel the second and if charged for doing so ( I used to be ) reclaim the charge

I am basically at the same stage as you and yes, all deadlines start from after service to defendant - ie five days after you input the claim. There is then 14 days for the bank to acknowledge and if they acknowledge within that time a further 14 days for them to defend. Good luck JG - Just a quick note - if I have had any queries I have found the help line for the court - which you will find on their website - really good. Hi All
I requested my bank charges from the Bank Of Scotland 14 days ago today, I hand delivered the letter and list of charges to my own bank I therefore know they received the letter. Postie has been and gone today. Do I now do second letter giving them threat of court action or would I be better waiting maybe one more day incase it's in the post but not arrived also this time I won't be able to hand deliver, would I be better posting to my own branch or the head office address? Also if head office address where would that be?

Not sure if I'm using this to post this question in the right place....
My question is, if the illegal bank charges which I'm about to try and reclaim resulted in a service charge being applied to my accout, am I entitled to reclaim that back as well ??0
