    I would extricate your self from that account or get it closed. Get those charges claimed back - if your money is going elsewhere then they will just be taking it off themselves/your ex ;)

    If those are the only charges you have then a strongly worded letter setting out the basis for the unlawful charges claims might do the job...otherwise it'll serve as your prelim letter and when they take the money send your letter before action in.

    hiya esmerellda,yep have own account,only opened this as joint as ex couldnt get one,DDS have been cancelled and halifax have frozen the account,im in the process of getting charges back,including this £78,i aint sure if im able to take my name off account as its overdrawn?? how i see it,if its in joint names,we're both liable,may just ring halifax and tell them ill pay half,see what they say???? what do you think????

    This is a common tactic I've seen again and again. It is hardly believable that the banks employ solicitors and dont tell them what to do or why, is it ?

    One very good suggestion I've seen is to fax the details to the solicitor, the number should be on their letter but ring them for it if it isnt. The post office can fax documents for a small charge, probably costing no more than first class recorded delivery. They will have literally instantaneous receipt and it will not delay things any more than needs be.

    You need to go back to the bank and tell them you will let the court decide if they think the charges are fair :)

    Exceeding Authorised Overdraft Limit
    Exceeding Unauthorised Overdraft Limit
    Direct Debit/Standing Order/Cheque returned fee
    Irregular fee

    CANNOT BE CLAIMED

    Cash Machine Withdrawl Fees
    Account Service Charges
    Service Fee / Annual Fee
    Charges related to foreign currency transactions and conversions.
    Monthly account fees on certain type of accounts.

    Check the details of your charges against this list. Some charges may be named differently and if in doubt about a particular charge check with your bank exactly what it was for.

  • Halifax owe me £1958 but I have agreed to accept £1700 and not charge them interest if they pay up in 14 days without going to court.

    No reply to my first letter then usual canned response "we are allowed 8 weeks to reply" to second letter when I stated my intention to sue and specified (as above) what I would accept to resolve the matter.

    On day 10 so far - and no joy when I rang them today either so although the FSA may give them 8 weeks, I don't want to. Am I correct in sticking to the 14 days I gave them??

    It's our fault they have insufficient staff dedicated to sorting the huge amount of claims they must be recieving and won't face up to the fact that they are on a bit of a sticky wicket here. I think it's a delay tactic too!

    ANYWAY it seems likely I will have to file a claim for the full amount plus charges and interest.

    Without sounding totally stupid is it just a matter of calculating 8% of the above total amount (ie £156.64 ) or does it somehow depend on the date of each and every individual charge?

    Their credit card were a different kettle of fish however - all done and dusted and 80% of charges refunded within 5 weeks.

    I don't want to be cocky or arrogant after sucessfully getting back one set of charges but I don't want to be the first person to lose my claim!!

    You need to input each charge using Martin's Interest Calculator, linked in the article as this will work out the interest according to the date it was taken as a charge taken in 2001 will incur more interest than a charge taken in 2006.
  • Is anyone aware if I am entitled to I claim back £200 in relation to "administration charges" and overdue interest on a car loan through GMAC (vauxhalls' own finance) following the same steps as bank charges?

    The loan was settled 9 weeks ago.

    Those charges were not proportionate to the costs they incurred either.

    Any advice greatly appreciated.....!

    You should have a claim but it depends what kind of account you have... you cant claim atm withdrawal charges or service charges - ie for banking cheques on a business account.....

    which bank are you with and what kind of account is it ?

    They were great. They said I need to keep in line with charges and that they won't close my account. I sent the 1st letter to my branch but they forwarded it to the correct department.

    I have also claimed from Argos and they gave me an offer of £30 instead of £75, so i'll send an acceptance letter but tell them i'll pursue the remaining amount.

    Debenhams have offered £60 instead of £117 but again i'll be looking for the full amount.
