    Hello.

    I'm reclaiming bank charges from HSBC. I've started court proceedings and have just heard that they've entered a defence. Fine. Bring it on.

    The charges were on two accounts - each about £900's worth (including interest that is). I claimed for them jointly.

    They've written two separate letters to me, one for each account. On one they've offered me £600 (about 85% of the total of the charges, which I believe is par for the course). On the other account, they've offered nothing, claiming that they don't agree that the charges are in any way unfair or unenforceable.

    It doesn't really matter - I'm still going to court to win the full amount anyway. I'm just curious as to why they might have opted for a different response for the two accounts. Any ideas?

    My second question is this - some people seem to be worried/scared at the prospect of taking a bank to court, especially with the OFT report due soon. I can't say I'm all that concerned but maybe I'm missing something. Am I right in thinking that the £120 Moneyclaim fee is the most that I stand to lose?

    Send them the next letter threatening court action following your timescale.

    As to different response to different account numbers, are both letters from the same person in the same department ? My guess is right hand doesnt know what left hand offered, quite simply.

    The moneyclaim fee is all that you have paid so yes, thats all you stand to lose if you lose. Thats a big fat IF by the way, good luck :)

    I guess all responses are not dealt with by the same person. Some big organisations are well known for the left arm not knowing what the right arm is doing.

    This should be all you stand to lose unless in exceptional circumstances you are asked to pay some or more of the defendants legal costs. This would only happen if you were deemed to have filed a 'frivolous or malicious' claim.
  • Can anybody advise.

    I filed on MCOL 15th Feb; HSBC £3666.68. They offered my £2600 which I accepted in part but would continue with court claim. They entered a defence on Friday.

    However, I have just received a letter from D G Solicitors (acting on behalf of HSBC) and they want a fully itemised breakdown or the amount claimed, listing, dates, charges, description etc, so they can 'investigate' my claim.

    Should I send all this to them, Should they be asking me for this....or is it a case of ignoring it and see you in court?

    Send it to them..... I assume you didnt supply a list to the court when you filed your claim ???

  • My letter requesting a refund of charges has gone to Nationwide today by recorded delivery.

    I have noticed in the success stories, that Nationwide seem to be getting to the court stage before making an offer.

    I am ready for it....and willing to take it all the way.

    Knowing my luck, I'll be the one they use as a test case in the court:eek:

    Claiming about £3k with interest.

    If it all goes smooth, I'll buy Martin a pint!:money:

    No, I did'nt. I just sent copies to HSBC with original claim letters.
    I will send it off.

  • Hi I'm just hoping someone can help me. My bank is Bank of Ireland and i live in N.I. For the last six years they have charged me anything between £40-£70 every three months if i went overdrawn in one or more of the three months. I got a letter every three months detailing charges such as atm withdrawals, direct debits, cheques etc, totalling up to £70 but ONLY if i went overdrawn. i totalled them up and they were £950 for six years. i sent the template letter to them but they wrote back saying that the default charges to my account were £0 and that all their charges are fair and equitable. Do i have a case to bring to small claims?
