    I started claim in small claims and Nat West have acknowledged. I did the claim on line. Should I have attached charges etc at this stage or is it only if the bank defend?
    Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

    HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

    Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

    If the bank put in a defence you will be sent an Allocation Questionnaire and with that you send your list of charges.

    If you send in your list of charges to the court to be served with your claim you will more likely avoid the lack of particulars defences and strike out threats that are being entered by many of the banks following a claim entered via the moneyclaim online service.

    This made me giggle....sorry....but a banks solicitor asking YOU to provide the information that the bank sent to you??? If the solicitor is defending the bank, shouldn't the bank have given the solicitor the information he needs to fight the case??

    they put a defence on mcol this morning but there was a letter o the doormat when i got home from work, sayin cheque will be in the ppost, im so made up, thanks everyone!!

  • Just to let you know that RBS paid £3460.62 that included interest! the full amount!! it took 3 weeks:T :T :beer:

    hi all
    I have been going through bank accounts from the last six years. The charges I think would be £5000 upwards, but the problem i see is that i had 5 with HSBC and 4 with Halifax.
    The paper work and letters ect would be huge.

    I also have had 8 credit cards during that period.

    Is there anyone out there who has had to deal with various accounts and succeded without having a breakdown.

    Advice will be much appreciated

  • hi all sorry am new and cant seem to find how to post this , I am pursuing halifax for my bank charges and they had the cheek to tell me that most people are not getting their money back and that you are more likely to get it back if you had a couple of accounts or mortgages with them is this true.

    complete tosh - the majority of people are getting most, if not all, of their charges back :)

    The hardest work will be working out each charge plus interest but you wont actually need to do this until you are at 2nd letter or court stage (if they dont settle to your satisfaction before then.)

    Dont send one letter per account. The 5 accounts and their total charges with HSBC can be listed on one letter as can the 4 with Halifax. This will mean just one letter per bank and cut down the work for now. Thats not to say they wont be ridiculous and send a seperate letter for each account but at least your replies can be condensed.


    I have 4 to deal with and am in the waiting for details/statements stage so I am just resting as much as I can for the moment :) It would probably help you to stagger the process and maybe do the banks first and then a few cards at a time. It all depends on how quick you are able to get refund in full or satisfactory settlement. Take a look through the success thread for some indication of how each bank or credit card provider tends to treat these claims for a rough idea.
