If you want to reply to someone in particular click 'quote'. This opens a reply box with the persons post in it and you can delete parts to ask or answer a particular point. It helps if the thread is busy and you get lost in the chaos
Edit: Click the edit button on your own post to add or remove text. It asks for a reason before you can click 'save' ... I usually put 'edit' or 'typo' in that bit.0 -
Hello,
RBS's solictors have handed in their court allocation questionaire. In the Other Information they stated the following:
"Case management directions cannot be proposed until the Claimant serves a reply to the Request for Further Information" which was due on the 9 March 2007. In light of this, the Defendent may amend its defence or apply to strike out"
What does this mean? I sent what I was advised to send by the court ie. a list of the charges. RBS's solictors were also asking me to send a load of other information with it eg. the whole of the act that I quoted in my POC.
Does this mean that my case won't come to trial, as it were?0 -

hi sorry to bother u probably been asked this before, i have two separate accounts that i am claiming for and i am in the middle of going through moneyclaim taking natwest to court on the court letter shouls i add the two amounts together and claim as one total, only thing is as one account is business and the other is private i am over the six years by about 4 months.
p.s. thanks for all your help so far have been at this since nov 21st but refuse to give up.0 -

I think it is an official part 18 request. It says "This request is served to CPR Part 18 alternatively with regard to CPR Rule 27.2(3).
The claim is for roughly £4420.
I sent them a list of the charges. The list of the charges only included the date of the charge, how much it was for and the interest.
I haven't been ordered by the court to respond to the part 18 request, yet.

NO keep business and personal accounts seperate as the legal bits you need to use is slightly different. Don't include the UTCCR etc for business as its not applicable.
If you are over the 6 years I would STOP using MCOL - go and get the N1 form from https://www.hmcs.gov.uk and include reference to s.32 of the limiations act within your particulars of claim.LegalBeagles0 -

Okay. When you sent in the list of charges in repsonse to the part 18 did you write a letter saying you were aware that part 18 request don't apply to claims in the small claims process (ie under £5k like yours) and that if the court requests you to complete the part 18 you will happily do so.etc etc.
I'd guess at no...
Soooooo.....I think the entry on their AQ is an attempt at imtimidation but I would write to them, and copy to the court a letter saying basically what i just said. READ UP ON PART 18 in the CPR's first so you know what you are talking about.
