I sent my letter off to the Coop Bank on 26 February giving them 40 days to reply, I rang them on Friday to ask why the delay in replying, they said they knew nothing about any letter etc etc, also there is a possibly that I might get charged for going overdrawn, which looks possible this month, so help please on both subjects? What do I do if they charge me £35 and do I send another letter?

    I am looking to make a claim against Egg for my credit card but I was wondering if you can claim merchandise interest back, sorry but I have not go a clue.

    just leave it as court or put county court, you do not need to name the court at this stage....

    received letter saying looking in to 21/02/07
    received letter saying still looking in to 14/03/07
    received offer 16/03/07

    took a while but i never sent the letter threatening court and im still a happy bunny!!

    Did you send a £10 cheque? if so have they cashed it? if not and didn't send by recorded/special delivery then there is no proof of delivery... Afraid you'll have to start again, If you have got proof of delivery by one of the above methods then they haven't had 40 days yet may still be processing it..

    As for the £35 charge, claim it when you put your first letter in requesting your charges back...

    Barclays have entered a defence and now I am worried!

    I have been sent an allocation questionnaire and a copy of the defence and need some advice on what they are trying to say:

    1) The particulars of the claim does not give precise charges and dates of charges (although I sent Barclays a breakdown of the charges when I started to dispute them) and so they can only offer a bare denial(?). Therefore they request the claim be struck out(!) as it does not disclose reasonable grounds for bringing a claim and is an abuse of the court's process (!).

    Will they throw it out? Should I have posted another set of statements when I started court proceedings? Can I get away with showing the court my statements at the hearing? Surely Barclays would have a record of my bank charges?

    Firstly my charges nightmare began due to a horrific divorce!!!
    Had statements through at beginning of Jan 07, wrote asking for all charges to be refunded, they wrote back and said I was getting NOTHING. :mad: Rang the number given and asked for a second review as the letter had advised, they paid me a goodwill payment of £750 within two weeks.
    I then decided they were toying with me, I'd had enough of dealing with the monkey and went straight to the organ grinder and filed a court claim using the Moneyclaim online website.
    They defended the claim and there written defence was so scathing and intimidating that I was livid!! :eek: The thought of going to court didn't bother me in the slightest, I'd seen all of my local District Judges in the process of my divorce, after my ex-husband Lloyds TSB didn't faze me in the least.
    The claim was transferred to my local court in Cardiff, within a week I had a court date, within 48 hours of that I had all outstanding monies paid directly into my account PLUS the cost of filing my claim with Moneyclaim website.
    Don't be put off by poncy solicitors, they're taught to talk as they do and are only doing their job, in my experience District Judges in local County Courts are extremely helpful to unrepresented claimants. I used all the templates from the Money Saving Website, it was never difficult or excessively time consuming. My advice would be - GO FOR IT!!!!
