You should be fine. The claim is in your name and address....

however you could amend you claim, depending on how much the claim is for, as the amendment will cost you £35 which you can't claim back.

you would also be able to upgrade your POC to the N1 template and attache your schedule of charges,

FWIW my first claim I forgot to put the a/c number on it, the bank wrote and ased me for it, I gave it them, it was noted in my claim file by the court cause i sent them a copy of the letter, and all was hunky dory (and I won)

Why do you need to put the court address in your LBA ?

  • hi there all,

i have sent away the first letter stating how much i'm looking to reclaim from the bank (£1700). i'm banking with Halifax Bank of Scotland. i received a letter a few days ago saying that they have a legal right to take 4-8 weeks to investigate my personal complaint.

so i'm unsure as what to do? do i wait 4 weeks before sending the second letter threatening to take them to small claims...? has anybody delt with HBOS before? is this normal...? any help would be most grateful.

    regards

Its pants :D Send the second letter 14 days after the first letter......

they are trying to get you to comply with their shoddy complaints procedure....you carry on to YOUR timescales and get your money back.

Always stick to your own timescales, not theirs. If there time is up, continue on to the next letter :D
  • Got all my statements from HSBC. For 2 years I was charged a standard £27.49 a month, this charge mysteriously stopped in January 2003. Since then there's just one figure a month saying 'Total Charges' ranging from £8 to £150 a month! Any idea which of these I can claim and which are standard fees???

Ok so I am claiming from Egg for charges on my credit card. After ny first letter requesting charges got a letter back saying don't think charges are unlawful, won't be paying etc.

So sent the next letter threatening court action. Got the following reply:

The Office of Fair Trading indidcated that it would not proceed further against Egg on the basis that Egg reduced its charges from £20.00 to £16.00.

Egg takes steps to help you aviod charges. For example the agreement requires you to maintain a direct debit to make your monthy payment so you won't miss a payment. You can avoid going over your credit limit by checking your account online at any time.

I am now due to start a court claim and am aware that this may be a "put off" letter but does anyone know if what they say about the OFT is true?

Don't want to put a court claim in if so and also, I've searched for other people who may be claiming off Egg and can't find any so is this why?

    Thanks

No address needed either leave this bit out or put in the name of your local court.
