So, i've returned home today, having begun a small claim against Alliance and Leicester (expiry of small claim - 3rd April), and found a cheque for the full amount on my doorstep. :j
The letter accompanying the cheque is the usual, "this does not mean we do not stand by our charges as we still believe they are fair and transparent" blah, blah, blah.
They have said in the last paragraph, "as it seems i no longer agree with their terms and conditions, they will be in touch soon to discuss the future running of the account".
2 questions then:
1: What should i say if/when they phone me to discuss the accout. I have already moved my banking to another company and have only left enough funds in my A&L acct to keep it open, but don't wish to be bullied into closing the account.
2: They have asked for confirmation i am settling and accept their cheque, is there something specific i should put in my letter to them (maybe a template i haven't come across yet?).

My claim going through small claims and the bank really dragging their heels. If the bank have added further charges since putting in the claim - can these be claimed back and if so how?Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!
HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.
Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA0 -

The story: Requested copies of bank charges (received six years of bank statements free of charge). Sent first letter as per this site - within 3 weeks £235 put back into my account and a letter sent stating it was a goodwill gesture. Will let them off the other £10 and consider moving my account to the Alliance & Leceister which I set up in case there was trouble.

Started this whole process in Sept 06. Wrote the letters , worked out my charges, asked for them back with no joy. Started court proceedings (cost £80) and LLoyds put in a defence that my claim was 'embarassing'as they couldn't work out which accounts the claim reffered to or how I had got the total I was asking for! My response on the allocation questionnaire was that I found thier defence 'embarassing' as it was them who had sent me the list of charges and that I had simply added them together.....one week later, the full amount I was asking for, £610 was credited to my account.
My bravery was a result of reading the inspirational stories on this site and the Consumer Action Group - I've also just had £90+ refunded from the Cheltenham and Gloucester for my mortgage exit fee I paid a couple of years ago.
Thanks to all of you here, lets all encourage people we know to claim back this money which belongs to us and not these greedy institutions that make excess profits from their customers.
I've worked part time in at the Nationwide for a few years now and find it disgusting that it's usually the less educated and poorer customers (especially single mums - trapped by the farcical tax credit system of over and under payments) who have run up mountains of debt because of bank charges. I've now left the N/W and will start part time at the C.A.B. in a few weeks and hope that I can help get back some of those charges that the company I used to work for took off it's customers.:T

I'm reviewing my paperwork and I see my particulars of claim stateBetween the dates of 15/05/2001 and
25/08/2006 the Defendant applied numerous
default charges to the Claimants bank account
My maths isn't great but none of that is beyond six years is it ? (or am I wrong)
One of Barclkays defences is that some of my claim is time barred.0 -
No, its still within 6 years. 15/05/07 will be six years from the first date mentioned in your post.0

Both my husband and myself have had loads of charges against us over the last 6 years and believe that we wouldn't have got into this situation if they hadn't have kept charging us all the time, hence the reason for starting the claims.
I would be very grateful if anyone could give me some advise on the following 2 points, thank-you.
1. Is it easier to deal with one persons charges, then the other or could I send seperate letters regarding each of us at the same time (obviously in seperate envelopes and with 2x £10 cheques)?
2. My husband is self-employed and therefore has a business account, can we also claim the charges from that too?

- easier probably not but necessary yes - keep the two claims seperate DPA / Prelim / LBA / Court Claim - unless the accounts are joint account with both names then yes do it seperately
2. My husband is self-employed and therefore has a business account, can we also claim the charges from that too? Yes he can - you need to amend the template letters slightly to account for the consumer regulations not covering business accounts...not sure if theres any instruction on this on MSE, but as turtle said, there a fair bit of business claiming advice over on CAG.
