I fear I may have lost my chance to claim my money. I was offered £1462 of an initial £2206 claim. I decided to push for the whole amount, and reading that a user on this forum successfully emailed and received an offer online, i tryed that last night, giving t hem another 7 days to respond with a better offer.
I'm now concerned that if they do not respond with a better offer, am I still able to take them to court, or will my email be seen in any way as not following the correct procedure, and I may end up with nothing ?

This is not my success story but an aquaintance's who took HSBC on by letter, and after a few of them they caved in! Not a huge amount and he said it was never about the money but about the principle for him. Couldn't have come at a better time as he has just been made redundant. It took him about 6 weeks from start to finish. I am so pleased for him as I egged him on to do it and now he had success before me even!Reclaimed thanks to this site:

Guys, I need some advice, I started MCOL yesterday (after getting a letter saying they want until 10th Apr) against the Bank (HSBC) should get the claim form on Monday from Courts, but today in post I have received an offer of the total charges amount excluding interest, What should I do? Any advice would be grateful.0

Amount paid: £450.02 (plus £50 court fee)
I wrote to request repayment of charges on 1st February.
They replied on 7th February with the usual "charges applied in line with terms and conditions" argument.
I wrote back on 9th February threatening court action.
I issued proceedings through MCOL on 24th February.
Yesterday I received a letter saying they had "reviewed my particular case and have decided in this instance to settle". "This decision should not be regarded as an admission of liability on the part of the Company, as we consider the charges to be fair and reasonable".
A cheque was enclosed in full and final settlement.
They also said they would be in touch soon to discuss the future operation of the account as I clearly do not agree with the terms and conditions of the account.
Wouldn't and couldn't have done it without MSE website. Thanks to all posters.
Now onto fighting GE Money, Barclays, First Direct and OneStopPhoneShop.0 -
Hi i'm really sorry as this info is probably somehwere on this site, but i've been reading through and cannot fine the answers to my questions
from 2000-2002 i had store cards with Debenhams, Top shop & Index, i was only 18 and had just moved out of home with my then bf and i know it isn't an excuse but we did get ourselves in a financial state, and i did pay these cards when i should but they became too much and then the charges started, and after some time we actually defaulted on the cards they were passed to a debt recovery agency and we paid it off slowly but surely over the next year, then never missing a payment. :T
My question is if these accounts are closed but within the 6 years, can i claim those charges back? i think it was about £40 a month which then used to put me over for next month and so on. :mad:
Also can you claim on credit cards and is it the same principle? i had one with capital one which i paid off and closed as i was unhappy with them they wouldn't change my DD date and caused charges.

help pleas advice required
i have just got a repley back from Monument credit card i asked them to refund me £712.00 with interest they have written back saying i have asked for a refund for £618.00 ( thats the total with out interest). They are saying they are now charging £12.00 pounds in occordance with the office of fair trading bla bla.
However we are prepared to review defaualt charges in total of £516.00 but as a gesture of goodwill £280.50 which represents half of each charge.
what shall i do i dont want to accept that offer i would be happy with at the least £516.00 but no less .Can you advise me how to word it please please...

Hello all. I sent off my request for the list of charges etc 2 weeks ago today. As my £10 cheque had not been cashed I chased up trying to find out what was happening. Natwest seem to be pulling out all the stops to delay and intimidate. After being pushed from pillar to post we are told there is no record of our request. We cannot make this request over the phone. There is a HUGE backlog, they say...(good news in some respects as it means more people are fighting back!) But now, I have to start from scratch, pay another £10 (although one person from Natwest asked what the tenner was for!) and wait even longer. This time I will send it recorded, follow up with another phone call to ensure it is logged and probably get the run around for a few more weeks. Frustrating, but this forum keeps the candle lit for me!:j Proud to be dealing with my debts:j0

Can anyone help me with what seems to me a complex scenario.
Several years ago (around 2002-2003) I incurred charges on a Bank Account with the Halifax - around £400. I was unable to pay this amount and so opened a new bank account. The Halifax never chased me for this amount. Recently however I have received correspondence from a company (capquest) saying they have bought the "debt" and I now have to pay them (they are threatening me with legal actions, bailiffs etc which is all quite scary to me).
My question is can I still follow the bank charges reclaiming process even if the Halifax have sold the "debt" to Capquest?
Thanks for any help or advice anyone can offer me
