    Can anyone help please. I issued through small claims online 8 March against NatWest. Questions are:
    1. I believe there are 5 days for service which makes date they were served Monday 12 March. NatWest have acknowledged so they now have 28 days to put in defence from date of service. This means 7 April which is a Saturday. If they dont put defence in can I go for judgement close of biz Friday 6 April or have to wait until close of biz Sat 7th?

    2. If they defend, what happens then - I think it goes to local court but how long will that all take?

    3. NatWest have been really awful - claiming they havent received letters which were sent next day delivery and having made numerous telephone calls to try and settle this - it has been put on hold for a couple of weeks while copy letters sent. They were dreadful on the phone even requesting a further five pound charge for statement when asked if any further charges had been incurred on the account! Would it be worth writing to the court explaining this in the hope the court might be fed up enought with bank's delaying tactics to not allow them to defend or should I just leave it to run its course?

    Sorry to be nuisance with these questions but getting a bit nervous now and just want to make sure I am doing everything I should be so bank has no "get out" clause!! JG

    One other thing. If the bank have added further charges since putting in the claim - can these be claimed back and if so how?
    Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

    HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

    Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

    You won't be able to press the button until the "correct" time, which as this will be the w/end and a bank holiday may be even longer, please see MCOL's FAQ.

    It will be transferred to your local court and you will be send the AQ, guide to which is in the Reclaim Help Thread.

    No need, to be honest the court won't be interested, just deal with the facts of your case.

    Well the first thing is i used to have a Store card with hawkshead.
    One day i got a letter (Hawkshead letterhead) saying that they had been bought out by somebody else and due to change of ownership 'We at GE Capital bank' have reviewed our position and will shorly discontinue the hawkshead card service. it was then signed by GE capital. The balance was paid up and closed later.
    I wrote a letter to GE capital asking for charges of £63 plus interest of £23.57 back on the closed account on 14th Feb 2007. Heard Nothing.
    Sent another on 3rd March 2007 and to date heard nothing.
    Do i now just go ahead with the MCOL and let them worry about it.????

    In process of trying to get HSBC to cough up £1807.50 plus interest of £480.25.
    Had letter back offering £1573.00, so now preparing paperwork to file MCOL now, so will let you know how that goes.

    Had response from Cap 1, offering (and credited to account) £74.00 when i asked for £198.00 plus interest. Sent letter of thanks but get lost and waiting for response.

    Also now looking into Northern rock mortgage fees and overcharged completion fees.

    5. I have an MBNA business card, and noticed 2 charges on it for December 2006 and Feb 2007 for total £40 late payment, so i rang them to see why, First one was cos payment was 7 days late, ok guilty but £20 to tell me i hadnt paid £12............... then the second one was received 1 day late..... £20 again. So i asked for payment back referring to OFT ruling etc, its illegal etc. They point blank refused to credit the money, so i told them i was going to take them to court for it, they just said fine. So for £40 they are going to have to pay more in admin than it is worth. Im only doing it for the principle on this one but its £40 less i owe them when i get it.

    Thank you Edinburghlass and everybody else concerned, you are doing a FAB job and give us all the courage and determination to fight back.

    hi i am gonna try to reclaim my charges back from my bank but i owe them money through a loan that i have missed payments can i still try to reclaim my charges even though i owe them money thanks.
  • I contacted my bank requesting repayment of over £1500 inclusive of interest. They did not reply inside the timescale given so I called them to ask when they intended to reply. They advised because of the backlog it would be another 3-4 weeks.

    I decided at this point I would issue a claim online against them which was duly served early this week. Two days later suprise suprise they sent a letter to me offering a 65%. In the letter they state that unless I contact them within 14 days they will pay this into my account as a gesture of goodwill but without any admission of liability.

    As I have already started claim proceedings do I need to respond to this letter and advise I will not accept the offer? Or can I ignore the letter?

    The court advised that they have until the 1st of April to defend the claim.

    Any advice is welcome

    Capital One out of pocket!!

    Amount reclaimed:470.00
    Amount offered:470.00 plus 50.00 court costs

    1st letter issued 20.1.07, they offered 194.00, I rejected this and issued 2nd letter threatening court action , they still offered just 194.00. Filed for MCOL 12.2.07, they defended, but letter received 5.3.07 saying they do not accept liability but will pay up full amount. Cheque received today so am off down the bank !!

    You need to be careful if you've missed payments on your loan.

    Strictly speaking it's a seperate agreement, so they shouldn't touch it, but banks have been known to take action and claim they're not associated with charge reclaims. At the moment it seems very difficult to get the bank to reverse these decisions once they've been made.

    If you sent these registered and know they received them, you should proceed to the next stage and file a claim.

    i know that i have been unfairly charged over the past 6 years but i also owe the bank money through a loan that they let me have even though they could see my bank account wasent that great at the time,will i be able to claim even though i owe them money and have missed a few payments thanks very much.
