    This is entirely a matter of personal choice.

    Personally, I would now take this all the way. HSBC are unlikely to up their offer to include your court fee, and after all I suspect it was their lack of response to your letters that let it get to court anyway.

    It's really down to you whether you mind losing out on 110 quid and putting an end to it all or whether you feel you should fight!

    Think about it properly. But, like I said, I would finish off the process now - perhaps writing to them to accept it as a partial offer.

    I had a similar experience to this. I had no response from Barclays so I began the Money Claim Process. They then offered me £1000 against my claim of £3000. My perception was that it was the Money Claim action that promted their response and not my letters. Since I had allready paid the fee I declined their offer. It looks to me that your situtaion is not quite the same as tey have offered you almost as much as you are claiming expept now you are aslo £120 down on the deal. I'd say you have not jumped the gun as I believe you may not have got this offer had you not made the money claim. The fact that they have acknowledged the action is proof of that. Perhaps you point out to them that as you heard nothing you have incurred an expense of £120 and ask tem to add that to their offer

    Thank you so much Martin & CAG. My daughter has just been notified that Barclays, whilst not accepting any liability, will pay her the above. It was due to go to court on the 26th of this month after approx 6 months of correspondence. I really thought she would be the unlucky one that would have been made a test case out of because it was taking so long and Barclays' strong wording in their defence. I'm so glad for her I could :j .

    Barclays have entered a defence so I have to fill in the Allocation Questionnaire. Part of their defence is that some of the charges claimed are beyond six years. They were all within 6 years when I first wrote to Barclays but by the time I took it to court a couple of months of them ignoring me had passed.

    Here's my question(s)
    1. Should I reduce my claim to only the charges that fall within teh six years OR .....
    2. Should I leave the claim as it is but offer to reduce it by the ammount beyond 6 years OR ...
    3. Should I just leave it as it is
  • Thanks for the tips. My worry is as the 2 may have crossed in the post so to speak, they may think "We've offered him this and he still takes us to court" and then put up a defence. I was wondering if this has happened to anyone else?

    My heart says go all the way, as if they've offered this much they will probably pay up before court. My gut says cut and run!

    sorry to be a pain but what do you do to start claiming bank charges when your account is with a debt collecter and im paying them

    Claiming in Scotland so had read a bit about lower small claims limit here (£750) and also shorter time scale for claims ( 5 not 6 years) but decided to chance it a bit as the bank had sent me 6 years statements as requested.
    I did a bit of calculating before I sent the second letter asking for my money back i.e. the figure owed for only 5 years and also a figure I thought would be acceptable should they offer me a smaller sum of money ( after all the bank does incur some cost in covering my defaults!) I also decided that I would pursue two small claims in court if it came to it. Happily, that has not been necessary as the bank responded to my second letter within three weeks offering to pay the full amount requested. The money is not yet in my account, but I did only receive their offer yesterday!

  • Amount Claimed £330 and £403

    Bank Halifax & Halifax

    To be paid £352 and £414.00

    These charges were from 2 years ago and resulted from one mistake when money was drawn against the wrong account, subsequent charges from Halifax a rose due to first charge being drawn on the day salary was paid in.
    Caused mayhem for a few months until caught up. Learnt from it and never been Overdrawn since, now got £750 to use on a holiday this year. Only had to send 3 letters for each account to get a result.

    Martin your muttering etc have changed my finances for the good over the couple of years,

    It is the same process as if it wasnt with a debt collector with regard to requesting details and sending letters and the court stage. You deal directly with the bank, not the debt collector. The only difference is that any refund will be first allocated to the debt and any balance issued to you afterwards. If there is nothing left over at least it will have reduced your debt and so it is still worth reclaiming for that.

  • Help this is my first time, not sure if I`m doing this right. I have tried to reclaime my bank charges from abbey and all they have sent me is one years bank statments not the last six years. What do I do now
