  • Sent letter and £5 standard cheque to hbos for statements 3 or 4 weeks ago phoned them today and the cheque just cleared last night or today, any ideas when i should recieve my statements???:confused:

    How long is a piece of string ? :)

    Timescales vary between banks but the deadline for responding to your request is 40 days so allow this time before issuing complaint to the Information Commissioner in the absence of a response.

  • Another victory (second day in a row) not had to resort to court, yet.

    The Halifax have sent me a rather polite letter offering £1,028 (what I had asked for!)

    Halifax: claimed £1,028, received £1,028
    Yorkshire Building Society: claimed £1,070, received £1,134.20
    Co-Operative Bank: claimed £560, received £575
    BOS Mastercard: claiming £184, 2nd letter sent 27/3/07
    Capital One Visa 1: claiming £439, 2nd letter sent 27/3/07
    Capital One Visa 2: claiming £842, 2nd letter sent 27/3/07

  • Have just received two letters from the Halifax relating to two separate accounts, they are refunding £2004 on one account and £881 on the other. Exactly the amounts I asked for. :beer:

    It has taken just under three weeks, four letters from me, and one letter from the Halifax acknowledging my "complaint". :rotfl:

    However, although they say they will be making the refunds to both accounts, they also state that this will be within the next 14 days. So no money received - yet.... :mad:

    Worse still they had the audacity to include leaflets with both letters explaining the very same bank charges, yet by offering the refunds they have effectively admitted that they are wrong! :mad:

    Asked for £364 + interest
    Paid full claim

    Sent letter asking for money back & 14 days to respond- NOTHING
    Sent next letter asking again & giving further 7 days- NOTHING
    Filed court claim on 23rd Feb
    Received letter 2 days later dated 22nd Feb offering £364 (full amt but no interest or court fee).
    Kindly rejected as already filed court claim
    Cheque received yesterday for £611!!! Which is chgs + interest + £80 court fee.

    Chuffed to bits with my little success!!:money: Thanks Martin & everyone on here for the advice:money:

    I though that this might be of interest reference Lloyds TSB credit card
    (formerly Scottish Widows)
    9th January - claimed £401.00 default charges.
    19th January - charges not hidden, charging policy is fair, ultimately it is only
    a Court that can decide whether a term is unfair in legal terms
    credit card services are free, late payments etc., cause us a
    cost.reply from Bank
    23rd January - my letter asking for payment, seven days to pay.
    26th January - Banks position has not changed from 19th January letter.
    5th February - MOCL online claim against Lloyds.
    14th February - Acknowledgement of Service defending the claim, that no
    monies are due to me.
    26th February - Notice of Transfer of Proceedings to local court
    2nd March - spoke to Brighton office (as Courts suggest) asking for
    default charges plus court fee to be repaid.
    5th March - letter from Lloyds offering to reduce the charges to the OFT
    recommendation (which they don't agree with) of the £12
    charge, meaning £139 plus interest totalling £160.38. This
    was a different stance to their defence which stated that
    no monies were due to me. My claim is £401, Court Fee £50, Interest £57.77 total £508.77
    7th March - my letter confirming my tele. conv. of the 2nd requesting
    settlement of £451 would end the matter. This obviously
    crossed with their letter.
    9th March - Allocation Questionnaire completed by Lloyds
    15th March - my AQ completed and returned to Court.
    16th March - contacted local Court to check if they had received AQ
    Informed that all Bank cases now transferred to Cardiff
    County Court to be dealt with by a District Judge who is
    only dealing with Bank cases.

    Acknowledgement of claim means just that, that they acknowledge the claim. If they dont file a defence after this within the allocated time then you win by default. If they do you will be sent a copy by the court. It is entirely possible that they will settle by phone or letter in the meantime and the success thread gives plenty of examples where they have done so.
