Hi when do the 40 days start from is it the day u post the letter

There is varying opinion on this with one that it is counted from the date they receive the letter. Since they often dont reply past the 40 day deadline (you can complain to the Information Commisioner if this happens) I would personally allow one or two days from the day you posted it to allow for post and count from then.

Hope that helps and good luck :)
  • Ive sent mine by recorded delivery did u?
  • Hi all, please excuse my naivety, but do I send my letters to my banks branch or customer service department or the 'collection' centre? I'm abit confused!:o

Halifax have acknowledged my claim what exactly does this mean that they will defend my claim or may they still cough up the money by a telephone call or in a letter. Thanks
  • your branch is fine, make sure you send it recorded delivery so someone has to sign for it

im in same position Halifax acknowledged my claim yesterday how long did it take for court papers to come as to what they intend to do.

I sent my first letter to halifax on 27th feb, got a reply dated 5th march, second letter has now been sent but no reply, it seems they are quite erratic, some people get theirs settled quickly, others a lot longer

Im at the stage of sending away to claim my money i have all the charges with interest tallied up and printed out, theyre due me £1558.97 incl interest.shall I just send it off? and should I send it recorded delivery?

Yes send it off today and as recorded delivery. Good luck :)

Edit: oops I see from your latest post ( before I posted) that you already have done. Ignore me completely then this advice is redundant :p
  • Yes, I did. The question I have got is whether banks are really entitled by the FSA to respond within eight weeks to complaints rather than the two weeks put forward in the standard templates? Do you know?
  • Excellent, cheers Steviebee, I'll get and do that this afternoon.;)

Can somebody advise, please? I have fowarded the standard template requesting payment of accumulated charges. In it I stipulated that I would take court action, if I did not receive a response within two weeks. I have now received a letter back from my bank advising me that they are looking into the complaint and that the Financial Services Authority gives them 8 weeks to investigate and respond to any formal complaint. Is this correct? Shall I wait until the time lapses or advise them now that I will take court action if I do not receive a response within the two weeks? I am also concerned with waiting for the full 8 weeks due to the awaited OFT announcement coming up soon...

Firstly please dont worry about the awaited OFT announcement. Indications from various sources say that it will have no effect on claiming for the full amount. See the OFT thread here for some further information:

As to their delay of 8 weeks, ignore it and proceed with your own timescale. Others have done so and been successful and I wish you luck :)
