I decided yesterday to go down the route of claiming through the FOS and am waiting to hear from then re the procedure.
I have sent the first LBA to LTSB and CB and the 14 days are nearly up. Can I send the 2nd letter threatening court before getting FOS involved on the (slim) offchance that they will make me a decent offer.
I know the FOS won't get involved if I have taken court action but will they if I have just sent a letter threatening it?

    Hi Folks...

What is happening in April, seem to have missed this i am awaiting a decision by the HBOS. They have said they will be contacting me no later than the 16th of April.. will this suggestion have any affect on previous claims made before April???

You are wearing me down :p When you say the first LBA do you mean just your first letter asking for your charges? If the answer is yes, then send out the second which is known as the LBA, letter before action, as it won't do any harm meantime.

You need to file at your local court, please read this thread...

  • Hi

I have recently refused a "gesture of goodwill" from Barclays for £500 as my charges are in the region of £1500, I wrote giving them 14 days to reply to my request of full repayment of the charges without interest and to also advise that they had sent me letters addressed to another Barclays customer and question them over their commitment to customer confidentiality and Data Protection Laws (thought this may help my claim) I have received a letter back from them advising that my complaint has now been sent to the head office and it will be the 8th April before I get a response. In light of the fact that there may be a court ruling on these bank charges due at the end of March could I ask if anyone has experienced these delays recently?

Well, in April its Easter and I'm off on holiday for a few days but I don't suppose thats what you want to hear :)

Is this reply from HBOS after your first letter? If so don't wait until 16th April and send out your next letter. Please read this post by Martin regarding OFT.

    Sorry:o :o:o

I hope I have the same efect on the banks!;)

I already have all my charges so that was my first letter asking for full refund. I sent it on 3rd March. I just don't want to jeopardise my claim with FOS (which I haven't started yet)

Thanks Edinburghlass.:T It's the patience of a saint you have :A

......Haribo slopes off to think of more obscure questions
