Ive Got A Graduate Bank Account With Barclays So I Only Get Charged £10 If I Go Over My Limit.......some People Say That This Is Within The Legal Limit For The Banks To Charge You So I Cant Claim.....and Others Say That All Charges Are Illeagal And I Should Put A Cliaim In........theyve Charged Me About 4 Times A Month For The Last Five Years So They Owe Me A Lot Of Money.....

First Direct have yesterday defended my claim, (little bit scared now )
Do i have to do anything now, or just sit and wait ? I believe the court may send me some papers.
Any help advice would be gratefully recieved

Hi all
Lurking for ages but very few posts.
1st letter to Barclays claiming £1440 of charges sent 5th Feb - ignored
2nd letter sent 21st Feb - ignored within 7 day timescale but standard "looking into your complaint" letter received after MCOL process started (£1759.05 inc interest).
They have acknowledged the claim and I now have the paperwork from the court which is marked "I intend to defend all of this claim".
Followed the process on this site to the letter - used the templates et cetera.
Anyone else been here? Am I really looking at a court date. Getting worried...

You need to check what each charge is actually for to ascertain if you can claim for it.
The following is a list of charges you can and cant claim for. Thanks to Rex_Mundi for the original post.
CAN BE CLAIMED
Account misuse fee
Cheque return fee
Card misuse fee
Unarranged borrowing fee
Unauthorised overdraft fee
Unpaid DD fee
Unpaid cheque fee
Unpaid standing order fee
Late payment fee (credit cards, store cards, catalogues etc)
Exceeding Authorised Overdraft Limit
Exceeding Unauthorised Overdraft Limit
Direct Debit/Standing Order/Cheque returned fee
Irregular fee
Paid refferal fee
Total charges (HSBC personal accounts only, not business accounts)
CANNOT BE CLAIMED
Cash Machine Withdrawl Fees
Account Service Charges
Service Fee / Annual Fee
Charges related to foreign currency transactions and conversions.
Monthly account fees on certain type of accounts.
Normal overdraft interest charges
Your bank may have different names for different charges so its worth checking with them exactly what your charges are if not named as above.

Can somebody advise, please? I have fowarded the standard template requesting payment of accumulated charges. In it I stipulated that I would take court action, if I did not receive a response within two weeks. I have now received a letter back from my bank advising me that they are looking into the complaint and that the Financial Services Authority gives them 8 weeks to investigate and respond to any formal complaint. Is this correct? Shall I wait until the time lapses or advise them now that I will take court action if I do not receive a response within the two weeks? I am also concerned with waiting for the full 8 weeks due to the awaited OFT announcement coming up soon...0

I have done it - taken on my bank (Northern Rock) and won HOORAY!!! :j :j :j
Followed all the adivce - used the template letters :beer: . Got the usual replies from the bank about T&C's, it being my ignorance in not understanding legal issues etc. Filed a claim using MCOL - I must admit I was a little scared when the bank said they were going to defend my claim until I read the numerous posts on here saying this was a bullying tactic to scare you off :rolleyes: . The bank have waited till the very last minute (2 days to go), filed thier defence the very same day that a cheque arrived for the full amount claimed plus court costs
