    You can only claim for charges that have actually been taken, as these haven't as yet been charged you need to address these charges separately as you suggest by asking them not to take the charges in the first place.

    Although if it comes to taking them to court you can of course add in these charges at that point provided they have been taken.

    id rather they didnt take them in the first place! should i just reword the letter i sent originally, saying i beleive these charges are unlawful etc and ask them not to take them?

    I had this with Egg. I made a list of my charges they had taken over the past few months and there were 2 that were due to come out about a week later.
    I added these onto my charges list but put in brackets (due on XXXXX and put the date it).

    I then worded into my letter that I was claiming for XXXXX amount and there were 2 charges totalling XXX due to be taken on XXdateXX. I told them that if they continued to take these charges, I would also be claiming for them making a total of XXX.

    Hope this makes sense :D

    just had my second letter from Nationwide declining any payment for bank charges, is it now time to start proceedings for court?

    They did say if i was unhappy to contact financial ombudsman.

    Any advice very appreciated..

    This will just be one of their standard letters to try and put you off claiming. Have you sent them the "threaten court letter" yet or just the letter requesting your charges back?

    Send the next letter but if you have already done this, just continue with your court claim :rolleyes:
  • If I close my account before I have recovered the charges, does this make any difference my ability to reclaim the charges?

    "I have a claim with HSBC for £850. Went through the first letter, then the second letter, with no response. The same day I went to moneyclaim I received a letter saying they are looking into it.     The story: My son was receiving bank charges on a regular basis which I felt was unfair, I saw Martin Lewis on TV and visited his website. My son downloaded the template letters. The banks reply to the 1st letter was a bog standard reply "we are looking into this for you". After 2 weeks my son sent the 2nd letter threatening court action, within a couple of days he had a reply. The bank was not admitting liability but felt that a court case would prove time consuming and costly, because of these reasons they were willing to pay him £970.00. Not a bad return for the effort of sending 2 letters! Thank you Martin Lewis!!
