    Apparently Natwest now have a 'spreadsheet' that tells them who has taken to court...

    My question is I signed and agreed to that settlement, can they now just turn around and now not pay up? Just really annoyed as it has only just been mentioned now just before bills are due to be paid etc:confused:

    Hi

    You will note that on the NatWest offer it states 'in full and final settlement'. If you have amended this to say you only accept it as a partial settlement, NatWest may not agree with these terms and can decide not to pay you.

    You will have to go all the way to get your cash now :undecided

    Thanks Twinkly...I am trying to contact Cobbetts to speak to them about it as I am sure that this cannot be done once I have signed and agreed?

    I am just so frustrated as I of course expected the money to be in my account and of course stupidly plan on paying bills etc...arrrghhhh wait till I get through on the phone:mad:

    well crap I just royally screwed up.... I didnt notice the word 'partial '.

    My only reason (not excuse. cos there is none ) is that I have been on the forum far too long and intensely today and my eyes are like @.@. To that end I completely apologise and some of my advice is now defunct (withdrawing court proceedings) so ignore it ...I am so sorry :(

    It still stands though that you can take them all the way to court and since you already are then I advise to carry on :)

    Since she is probably on the phone now she will probably get this advice anyway. Thanks to Esmerellda and UNDERGROUND for pointing out my error, I do appreciate it :)

    The offer was actually not far off my original letter request amount...but that was back on 1st Dec and obviously since then have had more charges and court charges. Unless I accept the offer as per my letter dated 1st Dec and then go after the rest afterwards?:confused:

    One letter (template from here)one phone call and mysteriously my bank charges went back into my account. All £105.00. :j

    They would have received my threatening letter to take them to court today, the same day I found out the money went in.

    Just received a letter from them confirming they have put back my money and said that 'As you are aware the charges are valid and in line with the terms and conditions of your account'.
    Also they added as a gesture of goodwill!!

    Yea right!!!!

    They didn't even try to put up a fight, I sent them the first letter (template from here) and received acknowledgment within a week, 14 days later received a letter offering me the full amount as a "gesture of goodwill".
    Within a few days of the letter the money was credited to my account. No threats to close my account (although i'm moving bank anyway) and they haven't even taken away my overdraft!! The money received has enabled me to pay off my overdraft, credit card and store card (needless to say the store card and credit card have now been cancelled by me!).

    RESULT!!!!!!

    Thanks Martin, by following your advice my finances are finally getting into order!! :beer:

    If the further charges are included in the claim that is now at court stage then just carry on with the court case. If not I suppose you could try and backtrack to their partial settlement but only by withdrawing court proceedings and you would lose the court costs, they arent obliged to refund those unless you win at court. You need to consider your losses/gains either way.

    You may have a job getting NatWest to re-issue the original offer, since they now know you are prepared to take them to court.

    I think your only option is to carry on with your court proceedings for the entire amount.
