thank you twinkly heres hoping it works this time then

You're very welcome...there is a slight error in my post I wish to correct here since you have already read it. It should read 'you can adjust interest up until the court claim date' not simply 'court date' cos that comes after you have made the claim, obviously. Sorry for any confusion I may have caused :)

    Hi

i know this sounds really silly but i am newish to this stuff and when people are writing on here they always seem to use shortened words for everything?!?!?

Could somebody be so kind and let me know what the common ones are please!?

    thank you

Hi, I am new here so hello to all of you. I recently reclaimed 6 months of bank charges from Halifax. It was the 1st offer they gave me...I had to bite their hands off as I was in a very poor situation financially. Anyway, I had to sign a form when accepting money saying I accept this in full and final settlement. Does that mean in full and final settlement of the 6 months, or of the matter? In other words, looking back I was so stupid to accept their first offer and would like to reclaim the full amount...can I do this now I have already accepted their 1st offer 4 months ago? I hope this makes sense!
  • Hi All

I sent of my £10 cheque and my bank (Clydesdale) have agreed to send me 6 years statements :) but, in the letter they sent back to me they say "Please note, if you've requested any info relating to manual intervention on your account, there is no specific mention within the Data Protection Act and as such we are under no statutory obligation to record or provide this info".

Can someone please explain what that means to me in English?

Just joined the forum so if I sound a bit daft asking this sorry.

    Cheers

Basically that they will send a list of automatically applied charges but not ones where a member of staff has intervened, say to write a letter with specific detail regarding something, that you have been charged for. Its basically a way to give you an incomplete list of charges and theyre saying there's nothing you can do about it.

    added in edit:
You usually receive a letter that states that you have been charged for the sending of the letter.

I am wondering if it possible to successfully request all copies of written correspondence sent by the bank in the last six years as this would provide evidence of manual intervention where their details under the Data Protection Act do not. It is worth investigating.
  • Bank: RBS
    Amount Reclaimed: £1640.00
    Amount they paid: £1370.00
The story: The claim was made for charges incurred 1-1-2000 to when the account was closed Nov 2002. They sent me copies of statements from my old branch and waived the ususal fee (I wonder if they would've if they'd known what I wanted them for!!). Used the forms from the site here, took it to Small Claims, they put in a defence, went to the Allocation Questionnaire, then got a letter today to say they'll settle. Not as much as I'd claimed, but they're raking back the fixed fee for the account and interest. Fair enough I reckon, just waiting for the cheque now. Just waiting for LLoyds TSB to cave in now...
  • Is there anything I can do about it?

Having reached County court stage with Barclays I'm preparing my documents.

    Have checked this
post #8 in http://forums.moneysavingexpert.com/showthread.html?t=400981 reccomends a stock phrase for "G other details"

Should I not also add to that stock phrase information to refute soem of the counterclaims in Barclays defence document

    1) That they ignored my earlier letters
2)That when I asked for my money back it was ALL within 6 years - only their intransigence has taken some of it beyond 6 years FROM THE DATE I TOO COURT ACTION
    3) They claim no particulars of charges have been supplied - I sent tghese with my original letters. AT WHAT STAGE SHOULD I PROVIDE THESE PARTICULARS TO THE COURT?

Has anyone received their charges back from Barclays without it going to Court? I served my Court Papers on the 5th, and received notification from the Court that they had been served upon Barclays on the 7th.

I received a letter yesterday from Barclays saying they had received my complaint (?) and that they would look into it and respond by the 12th April. Would they call the Court Papers a complain? And the 12th April would be after the 14 days they are allowed to give me a response, whatever that is. Or perhaps it is a letter responding to one of the earlier ones sent to them (too late to stop me taking the Court action).

Would be grateful to know how far folk have found Barclays to go down the road.
