    Bank-NatWest
Amount claimed - £2140 (£1750 charges the rest interest)
    Amount refunded - £1849

They didn't pay up until my final letter before court action and I had already registered with moneyclaim and was days away from lodging a claim, when i had a long and garbled letter saying "sorry for complaint...we don;t agree... however reviewd your case....offered £1650.
I was happy to accept this, and cheekily wrote at the bottom of the letter "please increase this to £1850 as you have banged on £100 of charges within the last week" and they did!!!!! it was in my account within 4 days.
Well chuffed. Thanks for everyone on this board and the other board.

It is your choice but you have the option now of proceeding to the next stage although advice conflicts I believe as to whether it is 7 or 14 days. Personally I would wait a little longer to allow for postal delay and give the 14 days then proceed.

    Good luck :)

If I do write back and say I want the full amout, will they be able to take the 750 off me? I have no written proof they've given it back to me yet.

The Letter Before Action template on here now states 14 days.

    Amount Reclaimed: £50
    Amount they paid: £50
    The story:
Accidentally withdrew cash I hadn't got at cash machine. No notice there of insufficient funds. Online account and fairly inactive so don't check often. Overdrawn £13 and put £20 in as soon as I realised (< 1 month). Got two charges of £25 next month without any notification. Queried by phone and letter to say not refunded. Used template for next action, and refunded by return of post! Yippee - another thank you from me!

The period starts from when you issue the court claim.
Section 5 - is what the banks tend to rely on in defence - Section 5 of the Limitation Act states that the action must be brought within 6 years of the cause of action, ie. when the charge was made. The act also defines 'action' as meaning court proceedings. Practice Direction 5.1 (CPR Part 7) also defines the bringing of the action as the date the claim form is issued.

the ammount I claimed was correct when I wrote to Barclays but they failed to reply to any of my letters and so I began court proceedings roughly 2 months later. Should I take out the two months charges that have fallen behind the 6 year curtain and adjust my claim accordingly. What I don't want is for the claim to be thrown out in it's entirity

    Hi Guys,

I have submitted a DPA letter to HBOS and have only recieved partial statements, however, when i called to make them aware of this 15 days after they recieved this request they started my complaint. They did advised me they would contact me by 16th March. I have got a letter today stating they have 8 weeks and i should hear no later than the 16th April which will be after my complaint was raised...

What i am looking for is the 40 days have passed and still not full statements recieved. They have stated they are requesting the missing years again should i wait or go to the information commisioner....

I had a claim with RBS aswell and it is now fully resolved and was done in under 5 weeks from the DPA letter being sent i also got 2 charges back that were applied after i had sent my first letter...

    HAPPY DAYS.......:rotfl:
