    The story: Posted first letter on 28/02/07, got statements within three days and sent second letter the same day. Got an offer of £40.00 and sent a letter refusing it. Got home today to find a letter saying they will pay me the full amount.
    May not be a great amount but it was my first. Just Barclays and Studio to go!!

    I would ring the bank initially and explain the situation. I have an account with halifax and sometimes they will refund a charge like this as a 'one off' especially where a third party is involved in the error. I've only had to do this once. If they refund I see no reason to close the account but I would give the wages department a swift kick to get their act together :)

    Im new to this, so hi everyone!

    I thot id share my story of successfully reclaiming bank charges with the Halifax.

    It started in Jan of this year, where i was recommended the site by a friend and saw the article on claiming charges back.

    I sent the £10 cheque for the past 6 years statements, got them in 2 packages. when they landed on the door mat, i thot a bomb had gone off they were sooo heavy! I sent the 1st letter around 2 weeks later, about mid-jan. I got a reply, offering £300 of a £677 total of charges. I rejected it. I then sent them the 2nd letter, saying if they did not reply within 7 days id take them to court. Didnt get a reply and forgot to follow it up.....:confused: (must have got carried away with life or summit)

    I remembered about 3 wks later, and this time i sent my branch and head office the same letter but with recorded delivery.

    On the 7th day, which was yday i got a phonecall from the bank offering £600. i said i was looking for £677 sand they agreed!!!

    Waiting on the payment just now. cant wait, im soo happy!!!

    ( the bank did send a letter saying if i did not manage my account properly in future, they may consider closing it...)

    In the past i hav managed to get charges refunded, altho not all of them. I usually wrote a letter to the manager, informing him of my dire financial status, and they wud be refunded.

    Remember, if u dont ask, u dont get!

    MCOL have now sent me a copy of Barclays defence and a court form to fill in. It'll be my local county court.

    Just some first impressions at this stage - I'll have to read it all more carefully a few times.

    1) looks like I have to pay a further £100 for the privelage of going to court
    2) This site (MSE) seems low on resources, help or suggestions for people who have got to this stage
    3) Much of Barclays defence is guff about I agreed to pay these charges from the get go
    4) They say no particulars of charges were submitted - what guff a) MCOL offeres no space to include such particulars b) I sent this to Barclays with my original letters which they ignored.
    5) They dispute that the charges constitute an unlawful penalty - surely they're trying to dispute established fact and precedent here?
    6) They claim that some charges fall outside 6 years counting back from Feb 2007 but I originally asked for repayment by letter (which they ignored) in December 2006

    Any comments and advice would be appreciated.

    Yes, you should get this back if you win.

    Sure but it !!!!es me off since Barclays are the ones taking it to this stage and at the very last moment too. If the stakes were higher they could win by forcing an escalation of costs

    Thanks but I've read all that and followed it too. However it gets a bit thin once we get to the court stage - seems to assume this will not happen. [EDIT] sorry - the second time I clicked this it took me somewhwere else I'd not seen, I'll follow tis up

    Well they've failed in my case because I'm not scared. Nor am I impressed. Their defence seems to be a fairly juvenile piece of writing.

    Should I not also add to that stock phrase information to refute soem of the counterclaims in Barclays defence document

    1) That they ignored my earlier letters
    2)That when I asked for my money back it was ALL within 6 years - only their intransigence has taken some of it beyond 6 years FROM THE DATE I TOO COURT ACTION
    3) They claim no particulars of charges have been supplied - I sent tghese with my original letters. AT WHAT STAGE SHOULD I PROVIDE THESE PARTICULARS TO THE COURT?
