This may not seem to be absolute success, but it will do me! Got to the stage where Abbey had defended my claim and we were going to go to court. They offered me a goodwill payment of half the ammount I was claiming. I replied that I would accept the above ammount on the grounds that it allowed them a cost of £4.50 per transaction overdrawn. I thaught this a good idea, as we dont know what figure the OFT are going to arrive at later in the month, and £4.50 per transaction is better than £12, which I have heard is a possibility.0 -
My bank currently charges me for all transactions including using my debit card to purchase items, using ATMs for my own bank and others, each DD payment and Cheque payments, there is also an account maintence fee, these are not overdraft charges or fines but they amount to aprox £30.00 per quarter depending on usage, can i claim back any of these charges.???0

The story: I wrote a letter using the template on this site, sent it to my local branch and customer relations in London on the 1st of March 2007, Recieved 2 identical letters saying they had received my complaint on the 13th, Checked my online banking on the 14th March and found they had credited it back to meOnly a small one but it shows they are giving us our money back!

The story: Sent out letters as per templates, they wrote to me within 5 days offering £850 and asking me to call if I wanted to discuss. I called and basically said 'see you in court'. They then over the phone offered me £1050, I said I would discuss with my husband and call them back. I called them back about an hour later and said I would exept there last offer and the lady said ok £1250 will be in your account within 7 days. It was paid in 2 days later and appeared on my statement as 'goodwill gesture'!!!
I am now on to Lloyds! I wrote to them begining of month requesting last 6 years worth of statements and they came a couple of days later, all in seperate envelopes!!! My poor post man, its the most letters I will ever recieve in one day!. They must be losing a fortune in postage costs!!!. Least my statements from Barclays all came in one envelope!. I have just sent of letter asking them to repay the £807 they owe me. Fingers crossed will be as smooth as Barclays.Competition wins...:j

got letter from bank today saying that although my inital letter to get statements was accepted they now say they cannot get them to me within the 40 days required and will get to them when possible the reason being number of claimants, i feel this is a excuse to put me off but was wondering if anyone else had same letter? mines was from clydesdale bank, thanks0 -

The story: Sent initial letter 4.2.07, they said they'd look into my claim. Sent letter threatening court action 13.2.07, they wrote back disputing claim, so processed MCOL on 27.2.07. A lovely lady phoned me on 7.3.07 to say a full refund plus court fees would be issued.
Cheque received today. So easy to do!

Yes the statute of limitations act. This only allows claim for 6 years.
However some people are challenging this using sect 32 1 (a) and (c) This is a decision which only you can take. I would advise you reclaiming the charges prior to the 6 years first.

(1) .... where in the case of any action for which a period of limitation is prescribed by this Act, either-
(a) the action is based upon the fraud of the defendant; or
(b) any fact relevant to the plaintiff's right of action has been deliberately concealed from him by the defendant; or
(c) the action is for relief from the consequences of a mistake;
the period of limitation shall not begin to run until the plaintiff has discovered the fraud, concealment or mistake (as the case may be) or could with reasonable diligence have discovered it. ....
How far back can you claim if you want to utilise this information ? (c) reads to me as if the time limit of 6 years may not begin to run until the claimant starts claiming (discovers fraud etc). If I read correctly the clause is a moot point and cannot be used to claim back further than the original 6 years limit. It doesnt make sense to me ?0 -

It is your choice but you do have the option to stick to your own schedule and proceed with the 2nd letter at the appropriate time. Good luck0
