hi is there any reason why you can only go back 6 years in bank charges claims ? i have statements that go back to 2000 and halifax says i can only go back to 2001 is this true ? thanks in advance jon0

Yes the statute of limitations act. This only allows claim for 6 years.
However some people are challenging this using sect 32 1 (a) and (c) This is a decision which only you can take. I would advise you reclaiming the charges prior to the 6 years first.32.--
(1) .... where in the case of any action for which a period of limitation is prescribed by this Act, either-
(a) the action is based upon the fraud of the defendant; or
(b) any fact relevant to the plaintiff's right of action has been deliberately concealed from him by the defendant; or
(c) the action is for relief from the consequences of a mistake;
the period of limitation shall not begin to run until the plaintiff has discovered the fraud, concealment or mistake (as the case may be) or could with reasonable diligence have discovered it. ....the way forward is the consumer action group .co.uk0 -

Requested 6 year statments over the phone in late feb.Sent 1st letter off to them on the 2nd March .Recieved letter today 14th March offering £733.After phoneing them up and refusing the offer they now are offering the full amount. HOORAY SUCCESS !!!!
It will be in my account in up to 14 working days time.

It took a long time as they ran the time limits for everything to the hilt. I started before christmas, but they soon coughed up after the letter threatening court action. I know it's not all that I asked for, but if you subtract the interest, I'm only £300 short of what they took and like it says in Martin's article, thats nearly £1800 I thought was gone forever.
Hurrah!Only when the last tree has died and the last river has been poisoned and the last fish has been caught will we realise that we cannot eat money.0 -
hi i waited patiently a month (just under the 40 days limit( and got my statement today with no sign of a £10 fee to send me the statements out. So I went into my brighton lloyds and asked them to call their centre to check they had received the letter - he tried no answer and offered to reprocess it. I said no I did"nt want to wait another month and so was offered to wait 15 minutes for the list of charges to be printed off there and then for me to collect. So after a nice comfy coffee break, I returned thanked the staff and picked up not statements but just a list of 6 years charges. Why was this so simple? but anyway try it too if you're fed up waiting. I thought waiting 40 days to be told letter had misteriously got lost in post was too risky you could end up being delayed. question: what constitutes bank charges? do i include o/draft interest as well as excess fee my big ones are just two years of DD and it comes to a whopping £1600 now i've addedd it up I really am annoyed with the extreme rudeness of this cost it sure adds up jo0

You can't claim back normal overdraft interest, please read post 4 in the Reclaim Help Thread, link in my signature.0

you can claim back overdraft interest charged to you on the unlawful charges. Its a bit complicated to work out, but you are entitled to reclaim it.LegalBeagles0

I thought we couldn't claim back interest it was just the actual charges?0

you can claim the overdraft interest they charged you on the charges. ie. if they took £35 from you which was in your overdraft and they charged you intrest on your overdraft you would claim it back.
If they charged you £35 whilst in overdraft and you had spent £100 in overdraft too, the they charge interest on the whole £135, yo would claim back the part of the interest charged on the £35 part not the £100 part.
if that makes sense ?
the idea of claiming is to put you back in the position you would have been in had they not charged you in the first place.LegalBeagles0
