    Phone the bank and ask them what they mean by account charge.

    My story so far is that I wrote the first letter to HSBC on the 13th February and got the standard reply back from them that they would get back to me in due course.

    Hi there

    I have a similar story, except in my case they didn't bother replying to my first letter at all. I am sending the second letter today, the one threatening to take them to court.

  • the 'taking you to court' template letter did say 'you have 7 days to respond', now the template letter says 'you have 14 days to respond'
    why has it changed?

    I'm just presuming that if an account was passed to a DCA I just follows the same process and letters but write to the DCA instead of the bank? :confused:

    Hi - my first claim was with first direct and that was with a DCA - I just went straight to first direct. my claim was for £1800ish and they offerered £1400ish but they wanted to pay it straight to the DCA - funnily enough the amount offered was exactly the amount down to the penny of what I owed the DCA - I told them the only way I would accept the settlement was if they sent me the cheque as theoretically the charges owed by the bank are nothing to do with the DCA. first direct sent me the cheque.

    Hope this helps! just deal directly with the bank.

    Thanks for that - I'll explain the situation a bit better. I'm doing this for my partner and it is for a store card which got passed to a DCA.
    We requested the statements from the actual bank who dealt with the store card and there are only 2 charges in the matter of 4 years even though he was over his limit and missing payments.
    We think this is because is got passed to the DCA and would it have been the DCA who made the charges and not the bank? :confused:
    Therefore do we get in touch with the DCA and ask them what information they have? :confused:

    I would ask them both for a list of charges as its more than likely they will blame each other for the charges

    Thanks - yeah think thats what I'm going to do just wasn't sure if I could ask the DCA directly. Just seemed strange that they hadn't made charges when they could have - doesn't sound like a bank :rolleyes:

    I am about to tackle HSBC for £1732 but am a little worried about what to do if they decide to take it to court. I know most settle before then but you are always worried that the first is going to be you. So what happens or what do you do once you get there? And would I have to appear in a small claims court of their choice so could be London or who knows where. It not going to stop me at mo but may make me pause later.
