    Bank: HSBC
    Amount reclaimed: £1998.50
    AMount Paid: £1986

Story: after the usual letters up the court stage (I was too skint to file with MCOL) and several false promises (it's being looked at on friday, LIE, It's a priority case, LIE, a manager will call you back, LIE) and aphone call where I lost it slightly and nearly started crying, the offer letter arrived today for almost the full amount, usual guff about not admitting liability but as a gesture of good will.....blah blah.

Couldn't be happier with my new found wealth although a word of warning to Martin, if I ever see you in the flesh may just have to give you a big snog!!!!

Don't give up, you'll grind 'em down in the end!!!

I've been longing to post on this thread and now I have, and will again when Abbey, Cap 1, Barclaycard and HSBC see the light!!!!!!

  • Hi,

Just wondering if anyone has had any dramas with their credit rating being abused by the banks as a result of claiming back the charges? I bank with Lloyds TSB and am looking at a mortgage in the next 12 months so don't really need my credit rating destroying. However, the charges would go a long way towards a deposit. I know they can close your account, although I can't see them doing it with everyone, but can they touch your credit rating?

    Many thanks
    John
  • Citicards? I Have Sent My Letter To Reclaim Charges. Posted Recorded On 7th March - Have Just Checked Online With Royal Mail Tracking And Not Delivered Yet! Sent To Citi Financial Europe Po Box 49920 London Se5 7zf Ie: The Address On My Statement Is This Wrong Does Anyone Know? Also Has Anyone Had Any Success Reclaiming From Citicards?
  • Am in process of claiming a whopping six and a half grand for a two and a half year period. Their 14 days are up tomorrow! My problem is that I live in Scotland and ant threat to take them to court would have to be in the small claims court! Obviously dont want to lose that amount. Any advice?

hI, I'm in Scotland too but my claim is under the £750. Think you can split the amount up into a few claims of £750 each. Also there is another alternative where you can claim up to £1500 think it costs a bit more but not sure how much or what its called

  • Bank: Halifax:j
    Amount claimed: 2794
    Agreed claim: £2334

I must admit I cheated. As a single parent I'm a bit of a wimp so didn't actually do it all myself. I sent off and got my bank statements (they didn't charge me for them as I asked them to debit my account!!). I then got a company involved - Licit Legal who were fabulous.

I haven't had the money yet, but hope to have it in my account in the next few days. I am then going to go to the Yorkshire Bank and open a new account. The Halifax haven't threatened to shut my account but as they have refused to upgrade my account for the last 7 years I am moving.

Good luck to all those still reclaiming.:T

Yes, but be careful. I seem to remember that one of the only 2 claims that failed had something to do with the district judge being miffed that the claimant should not have split the claim in the way he did. It was lost on a technicality.

As Edinburghlass suggests, look at the claiming in Scotland thread - also bear in mind that your Bank may have an address in England that you can use. I used Halifax for a Bank of Scotland claim if it helps.

  • I have written to my bank (First Direct) to ask for a refund of charges, using the template letter but they have replied that some of them are not refundable. I don't know what they are - can anyone help me please as I can't find this information anywhere?

They are: £105 Recall and Unpaid Item Fees, and Electronic Funds Transfer Fees and Arrangement and Renewal Fees. Does it only apply to overdrafts? Although I have been given a time limit to accept their ungenerous offer, I don't think they can keep me to it, or can they?

Thanks for any help you can give me.

There were two cases (that I have read about) but unfortunately I dont have time right now to find and post the sources. Basically the first one was where a 2nd claim was disallowed on the basis that the guy should have claimed both amounts at the same time, as one claim. He was allowed the first. The banks defence to the second consisted only of that the second claim was an abuse of the small claims system which the judge ruled on and found against the claimant. It was nothing to do with whether the charges were right or wrong unfortunately.

The second one was where citibank claimed to have an expert witness (one of their own financial directors) and the result was that the claimant received the difference between £12 and the actual charge so there was some victory there at least. This case is under appeal at present I believe.

Perhaps someone with more time could give you the sources of these stories as they are pretty well known, or maybe someone else knows of other failures that I dont but I hope that helps for now.

Dont be discouraged by them though the success rate is huge as you can see from this site :)

Cloth - this was where i saw it. Be interesting to know the details but should be aware of this when splitting a claim...
