    HELP!!!!!! i sent my first letter 20th feb, heard nothin by day 14 so sent second letter, then when i was on phone to bank about something else i got told i had been awarded my charges back and the case was decided on 3rd march, for the full amount i had claimed for. After the first week i phoned and said i had not recieved letter, then phoned again on saturday just gone and the guy said he was emailing the person concerned to re-post my letter as i had not recieved it, now, they are past the time scale set in second letter, do i wait a few more days or just file the court claim, also if i do go ahead and pay the 120 for court will i get it back if the letter turns up day or two after, or will i loose that money !!!! Please help if you can !!!!

    You need to make sure you get this offer letter first so I suggest you phone the bank again and ask where it is, also worth checking your account to see if the money has been paid in.

    i have just got the list of late charges and charges for going over my credit limit do i ask for interest and use martins interest calculation spread format ? or is this just for bank charges ? and do i ask for the full charge or just the diffrence between the OFT ruleing of £12.00????????
    Any help please ???:mad:
    This is for a credit card by the way???????

    Bank: Alliance & Leicester
    Amount claimed: £1494.20
    Amount offered and accepted: £2162.21

    Asked for statements, got them within 21 days.
    Sent off letters asking for the money back. Got 2 shirty letters back saying no.
    Applied through MCOL. They said they would defend their claim last week - today recevied a cheque for full amount plus interest plus court fees.
    Thanks to everyone for their advice and support.

    Hiya!
    I have successfully claimed for 2 credit cards. I used exactly the same letters as for bank accounts and claimed for all charges plus interest. Claim for the full charge also not for the difference.
    They may send you an offer of the difference - do not accept this as you will get the full amount back - I did.

    Hi,

    I,m trying to get Martin's particulars of claim template to fir the online court claim but cannot seem to get there. The maximum allowed is 1080 characters on 24 lines. Do the gaps count as lines? With or without gaps I still get 26/27 lines and about 1090 characters!! Help!!

    No problem and don't worry - stick to the step by step guide and you'll be fine. It is taking longer for some people and is easier for others but stick at it ;)

    I was exactly the same when I did my very first claim - didn't believe it would work, scared they would close my account, scared I would have to go to court...you name it, I worried about it.
    But after my first claim I felt pleased with myself for getting it back so went on to my credit cards. Have won on 2 of those now so started asking for statements for closed accounts. Also doing my partners accounts too!

    It can get quite addictive :rolleyes:

    The story:
    Ignore all their letters trying to confuse and frighten you off and keep going to the end. Would not be possible without help of this web site. Also everyone should remember the real pioneers were the daily mail and the guy who first took abbey to court........:T
