    This battle with Lloyds has gone on for the last ten months and was due in court in April. Yesterday they paid £1034 into my account!
    I haven't had any notification that they were about to do this either.

    I had no idea I had racked up so many charges! Initial letter to the bank brought an immediate offer of settlement. I know I could go further, but I am going to settle at amount offered - I do appreciate that the charges were partially my fault and feel the offer is fair.

    Their immediate settlement may indeed be because they are in the wrong, but first direct's swift and non-confrontational style is very much in line with my previous experiences of them as a bank.

    Hi!

    I'm just presuming that if an account was passed to a DCA I just follows the same process and letters but write to the DCA instead of the bank? :confused:

    Yes they can - I have successfully claimed these back along with overlimit fees :D
  • Abbey have sent me 14 months of statements and told me in a letter that the rest of the details will be sent at a later date.
    Do I claim back charges from the statements now or wait for the printout and claim it back all together?

    There were two cases (that I have read about) but unfortunately I dont have time right now to find and post the sources. Basically the first one was where a 2nd claim was disallowed on the basis that the guy should have claimed both amounts at the same time, as one claim. He was allowed the first. The banks defence to the second consisted only of that the second claim was an abuse of the small claims system which the judge ruled on and found against the claimant. It was nothing to do with whether the charges were right or wrong unfortunately.

    The second one was where citibank claimed to have an expert witness (one of their own financial directors) and the result was that the claimant received the difference between £12 and the actual charge so there was some victory there at least. This case is under appeal at present I believe.

    Perhaps someone with more time could give you the sources of these stories as they are pretty well known, or maybe someone else knows of other failures that I dont but I hope that helps for now.

    Dont be discouraged by them though the success rate is huge as you can see from this site :)

    3 weeks ago I found this site and immediately set to work finding my statements for the past 6 years, I found all but 7 from 2 different banks.
    Totally gobsmacked that I had over £2,700 in charges taken out in just over 3 years, I decided to go for it. I wrote a letter, copied from this site, and posted it recorded delivery. That was 3 weeks ago today.

    I have today recieved a telephone call from Halifax offering most of the money I asked for. They told me they don't repay the interest so would I accept the £1,897? I of course said yes. They are going to send me a letter to sign and return, then they send me a cheque.

    Now I am off to book a well deserved holiday for me and my kids!! First one in over 5 years.

    Good luck to everyone and thank you for this site!! I will be coming back to this site to find help with my debts..... holiday first though...lol

  • When Barclays wrote with a first offer and I wrote back to reject it, I informed them I'd be charging them £30 for the letter as I don't have their economy of scale to automatically send out letters, and also because they were wasting my time defending unlawful charges.

    My question is - is it worth trying to add this £30 onto the amount when I log the internet court claim? And if so, can anyone suggest a modified template to use?
