i sent in my request for my bank statements end of feb.

I have now developed this huge fasination for my postman!! Its all i think about in the mornings! and when hes gone i feel this overwhelming dissapointment that its not the post i want!!.

    Anyone else have this problem?
  • I filed my claim on MCOL for £3666.68 (inc interest).
I can file for judgement on 20th March.

However, I have received an offer of £2600 in full & final settlement.

I was going to write a letter saying i would accept this as part payment, without prejudice, etc etc and continue with my claim.

BUT...due to the ruling that may come out in April, should I just accept this offer? Because, they may put in a defence if i dont accept it, which would give them another 28 days and that would be after the ruling date and I think I could risk losing everything??

So do I accept this offer or carry on?

    Anybody any ideas?

    Thanks.

The story: original letter sent 29th November 2006 went through the process as detailed on this site (letters 1 and 2) no joy so i started court proceedings on 12th February 2007. Today I had a letter to say they'll settle the above amount!!

Entirely up to you whether you accept but the OFT ruling wont make any difference to the amount you can claim. Please read the thread about this here :

    hope that helps :)

Barclays deadline came to fruition on Saturday. I later found that I could not claim judgement by default on a weekend as the 28 days ran til the next working day. Nor could I claim judement by default this morning - it appears they must be given the full working day to get their !!!!!! in gear.

Surprise, surprise they have entered a defence on the very last day.

You are unable to take any further action online on this claim.

The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.

I think this is disgraceful. they had a full 28 days to do this. Do they have some automated e-bay type system to do this at the last minute. They're nothing but crooks playing the system. I shall await teh next step
  • Thanks Twinkly.

I have read all the OFT stuff in the link and my mind has been put at rest.
It would seem a shame to back down now.

So I will carry on with the court claim!

I had the same thing... you're right they're just buying time - and a bit more interest on our money. But their days are numbered...

I dont know if this helps, as I dont know which bank you applied to.
    but,
HSBC - i went into local branch and they printed 2 years statements whilst I waited.
Barclays - i received a phone call after 5 days saying they were looking into it. 2 weeks later, postie turned up with huge parcel with 3 years statements.
Capital One - took 3 weeks, i received all photocopied statements, no problem.

Only bank to charge me was Capital One. Barclays returned the £10 cheque.
    HSBC did'nt ask for anything.

They all had 40 working days, but none of them took that long.

    Good Luck :D
