    I have claimed with HSBC & Barclays.

    HSBC is now with MCOL -They did say I would probably receive an offer within 8 weeks, due to them having so many claims coming in, but, I ignored this and filed a claim anyway. All banks seem to be delaying as much as they can. I received an offer last week, which I am accepting in part but continuing with my claim. The general advice is always...keep to your own time scales.

    Barclays never actually replied to any of my letters. I filed on MCOL yesterday, which was 2 days after their time was up after I sent the 2nd letter threatening court action. I am definately sticking to my time scales and not theirs.

    On both MCOL filed, I put Northampton County Court, as it is done on line. If it actually gets to the court stage, apparently they move it to a local court near you, so if your filing online just put Northampton County Court.

    The story: I wrote to the bank 22nd November 2006 requesting bank statements going back 6 years and enclosed £10. Wrote 5th Jan. '07 requesting repayment. 17th Jan.'07 wrote to bank stating that I am going to commence court proceedings to reclaim my money. 12th Feb made a claim through Money Claim Online. 5th March received a letter saying that Lloyds were making a defence against claim. 8th March received a letter from Lloyds TSB solicitors - advising that the bank will be settling my claim in full (inclusive of fees and interest) - hooray! result - Martin thank you for all your advice & help. :T

  • can anyone help me?

    I have gone through all of the stages with regards to reclaiming my money, The most recne tstep is that I recived a letter from the court basically explaining that there would be no need for a court hearing as the defendant hasn't bothered to send, witness statements, court bundle etc etc, so they pronounced me "winners" as such. i was told to fill in the relevant parts with regards to when I would like the money to be paid. This was completed and I even decided to go against the box stating "immediately" and decided to give a 8 day choice, why I bothered is beyond me as to day is the 8th day and guess what? yep, no money. I'm not only ready to rip someones head off but also mega annoyed that if I was in the position the bank was in the there would be no doubt that I was be in very hot water.

    sorry to go on and on, but has anyone any idea on what my next step is? Do I contact the court and go from there? any help would be very much appreciated.

    Contact the court, they are the ones to deal with it.

    The story: I did everything wrong & thought i'd thoroughly messed up, until i got a letter a few weeks ago saying i was to be refunded!
    I didn't know the full process in order, as i had never been on this site before; so i ended up taking Yorks bank to court straight away before warning them. I didn't fill in substantial evidence (ie: dates & figures) so the bank eventually wrote saying THEY were taking ME to court for wasting their time! I got advice from this site & quickly wrote to thebank & the court with my figures etc, thinking i'd lost already. A week later they replied & settled out of court.



    HOWEVER: I now need help from anybody who can advise me please:

    I am claiming back £1214 from Nationwide for my son. I am just in the process of completing the MoneyClaim Online and got to the charges bit. I was a bit alarmed to see that they had charged me £120. Am a bit scared now, as I cannot afford to lose £120 if we do not win the case. Any advice please....I would be very grateful.

  • Firstly, I would just like to say what a fantastic consumer revolution this is!! Massive thanks to Martin and his team(??) for the support that is being provided to everyone here!!

    My question is this: On 31 January I sent my first letter requesting that Abbey pay all the default charges applied to my account along with a print out of the total charges applied over the last six years. A matter of days later, I received another statement with two more charges so I sent a further letter essentially adding them to my previous request. They have responded with a reply along the lines of "sorry you're unhappy, we're looking into it.........". As far as "my" (thank you Martin) time limits are concerened, I have sent the second template letter advising that if I do not receive a full response within 7 days, that I will commence court proceedings. I am now due to take the matter to court using the on-line facility. My concern is that when I apply for the amount I wish to claim (I assume I will have to enter this on the claim somewhere), if the amounts that I am charged continue, what scope is there to re-claim these within the one court action?

    I have read something along the lines of "without prejudice", but to be frank, I don't really understand what this means. Sorry, I hope it's just the way that I'm reading it and that someone will explain in "Janet and John" type language.

    My apologies about the length of this post, but, like most people here I guess, taking on the big-guns isn't a decision to be taken lightly and if it DOES go to court, I would like to feel confident that I at least understand what I can and cannot do.

    Once you start the Money Claim online service you can't add any more charges to your claim.

    The web dictionary definition of 'without prejudice' states :
    The basic meaning is 'without loss of any rights'. It is a term used when two parties are in dispute, and one makes a settlement offer to the other. It puts 'without prejudice' on its offer to make it clear that the settlement offer should not be construed as a waiver of rights. Importantly, communication marked 'without prejudice' cannot be used in evidence in court proceedings if the attempts at settlement fail and the dispute comes to court.

    Very basically, that acceptance of partial settlement 'without prejudice' in writing doesnt have any effect on the full claim and you are still entitled to pursue the full amount if you accept it.

    Found Money Saving Expert through Google just before Christmas and on the back of it decided to proceed with asking my bank for details of the charges I had incurred over the last six years.

    The bank duly obliged and sent me copy statements (free of charge) in order for me to work out my own charges. I spent an evening going through the statements and then wrote my letter giving them 15 working days to credit my account with the unfair charges. First Direct paid the whole amount I’d requested "without prejudice" within the 15 days based on the fact that it would cost them more to take the case to court. My response: woo hoo!!! :D
