    Beats me why they've given me more than I claimed, but who's complaining?! 2 weeks after sending out the first letter detailing and requesting a refund of charges, I was sent the standard "we're wonderful, our charges are fair, you are a moron for getting into debt e.t.c." type letter, but as a gesture of goodwill and without admission of liability, they will refund the charges (and some!!!) They did point out that they would be forced to consider my position as a customer if my account is overdrawn again - WELL SEE IF I CARE, COS MY ACCOUNT IS NOW SWITCHED! (to A & L)

    started small claim court, they paid a week before it went to court.
    Thanks for the help, I know it is only a comparitively small amount but it is needed!

    Amount Reclaimed:2700 roughly
    Amount they paid:halifax 2000 roughly ( still 2 accounts to finalize)
    The story:followed the process and was on the court stage when halifax contatced us via telephone to offer me a full refund as a good will gesture, well worth the effort that is required as to get our money back

    Amount Accepted: £700

    First letter sent on 29th January 07, usual reply received....(we are looking into your query). Second letter sent 13th February 07 stating that I was willing to accept £650 for a quick settlement. Letter received from HSBC on 28th February 2007 offering me £700, which I have accepted.

    I can't believe how easy this was!!:rotfl:
  • I AM ABOUT TO THREATEN COURT ACTION AND AM USING THE TEMPLATE LETTER. WHERE IT SAYS,
    'This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the [INSERT NAME OF COURT] court will rule in my favour.'
    HOW DO I KNOW WHICH COURT NAME TO PUT?

  • edinburghglass....mornin to ye....my names rabbie an' i'm into the process of claimin' back £3253 from the a & l (just about to threaten to take it to court stage),could ye tell me is i can take them on in a n english court or do i need to do it in me own county court,obliged fer any feed back from ye.

    i was just wondering although we do hear all the lovely sucess stories, there isnt many failed?!?

    i just wondered whether anybody had been unsucessfull and what were the reasons for this!
