Before I go full steam ahead has anyone else who banks with the abbey had any success in doing this?
Also has anyone had their account closed down with the Abbey once they have been given back their charges?
Your feedback would be greatly appreciated.

I researched the success thread for all 4 financial institutions I intend to reclaim from, Abbey being one. Of the 15 Abbey cases reported in the success thread to date they have settled in full eventually, some very quickly and some make it to court, but all refund. In the thread there is one account reported as been closed and one as threatened to be but no update as to whether it actually happened.
If they close the account you can complain to the Financial Ombudsman and Abbey may be liable to pay you £200 compensation.

I Am Currently In The Process Of Claiming Charges Back But Because Of The Bank Being A Complete Waste Of Space They Have Charged Me For An Other Unpaid Direct Debit(there Fault But According To Them Its Mine) I Am At The Second Letter Stage There Deadline Was Actually Up On Thursday But I Was Short Of Money So Didnt Start A Court Claim, But I Want To Know If Its Too Late To Include This New Charge To My Claim When I Start A Court Claim.
I Tried To Get The Bank Charge Reversed Before It Came Out Went In Branch They Were Useless, Told Me To Phone Which I Did Got Passed On To About Four People Then Was Rudely Told It Was My Fault So Hung Up On Her Because Of Her Manner Towards Me On The Phone. Compossed Myself And Phoned One Last Time Got Through To A Nice Woman Who Mainly Told Me No I Wasnt Getting The Bank Charge Reversed Because Of The Claim I Have In For The Full Amount But She Did Say She Would Put It In My File For Them To Consider This Bank Charge If They Make Me An Offer. So Does That Mean They Will Make Me An Offer Its Been Over Two Weeks Since I Sent The Second Letter? Any Help Appreciated0 -

The story: Went as far as applying to the courts. HSBC responded with a defence but then, out of the blue, offered me almost what I asked for. Guess they didn't want to attend court!! Waiting for the money now - should be within 7 days.

It is not too late to include this charge in a court claim. You can add to the amount up until actually inputting data into the form online or your paper claim but you will need evidence of it to present at court if it actually makes it into the courtroom.
As for the nice woman that mentioned an offer they may make. Dont take this as definite although there is the possibility that there is an offer on its way and you may wish to wait a few days to allow for this to arrive. If it doesnt or is unnacceptable proceed with the court stage as usual.

Yes you can but the charges refunded will probably be first applied against the overdraft.0 -

Lloyds TSB Credit Card (formerly Scottish Widows).
I issued Court proceedings against LLoyds TSB for the recovery of £401 plus
interest £57.77 and court fees of £50 total £508.77. They have defended the
claim and I have an Allocation Questionnaire to return this week. I have tried
to deal directly with their Card Concerns people as the Courts suggest that
you try to strike a deal. I spoke to them again this morning and there was
an admission from them that they defend about one in twenty claims through
the Courts.

JS - Despite their claims and apparent lack of continuity in these cases, I think it highly unlikely that you will be faced with a defence here. Having read through many of the Lloyds TSB success stories, many people got to this stage and, after sending their AQs in, were offered settlement before the court date. I think you'll be fine, but this is where you have to stick with it.
Think about it - how do they select the 1 in 20 that they are going to defend? Do they stick a paperclip in a pile or what? you've just had a different response and it's clearly one that's intended to get you worried.
Relax and stick with the plan!

Just wanted to let people know of my success story in the hope that it will encourage people to keep going. Checked my account online on Friday and Lloyds had, out of the blue, paid in the full amount of the claim plus the amount that it had cost me to put the claim in. We were due in court next Tuesday for an allocation hearing. I didn't think they would back down yet but am very glad they did, my daughter and I had a lovely weekend!!
To everyone who is still going through the process, keep going, you will get there, and to those few who helped me out with advice, THANKYOU!!

Hi All
I submitted a claim for bank charges to HSBC on 26th Feb giving them 14 days to resolve the problem.
I got a letter on last Friday 9th saying they were 'looking into it' - do I ignore this and send my 'letter before action' showing my intention to proceed with a court claim now
