WOOHOO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! £1990 successfully reclaimed from HSBC!!!!!! I sent the letter demanding the charges back on Saturday 10th of Feb. Received the money on Saturday just gone. Less than 5 weeks in total. Im impressed. Now just to wait to see if they try close my account. Its already for me to close it but I want to wait a bit to see if they try close it. And if they do, its off to the ombudsman I do go.Bank charges reclaimed: HSBC £1990

Is anyone else claiming from Egg?
I sent my letter off asking for my charges back and got this reply:
"Your credit card agreement clearly states that charges will be added to your account if you exceed your credit limit or fail to make your payments.
We do not accept that our charges are unfair or lawful and do not propose to refund the charges that were applied to your account upon your breach of the Egg card agreement terms.
We would like to draw your attention to some of the points made by the OFT in the statement issued in April 2006 at the conclusion of its investigation into default charges on credit cards.
The OFT states that a default charge should only be used to recover certain limited administrative costs...the OFT set a threshold of £23 but stated that default fees should not be equivalent to the threshold...the ODT stated that the presumption tof unfairness in relation to charges over £12 would not apply where exceptional business factors apply and specifically referred to Egg's practice of requiring all customers to pay the minimum monthly payment by D/D....the OFT acknowledged that in those circumstances a card issuer may be able to set a fair default charges above the £12 threshold."
I'm still sending my next letter now regardless because I still don't think the amount is fair.
Just wondered if anyone had actually got anywhere with Egg though regardless of what they say?0 -

I wrote in Nov 2006 asking for my charges back. No letter appreared so I called my branch to be told that the letters were being dealt with in Scotland due to the volume of letters. I got a letter saying that they were dealing with it.
In Jan 2007 I got a letter offering full and final settlement. I was gobsmacked but accepted as it would be rude not too!

i have been looking into chasing my bank for my charges and they are £1857 without interest its £2140.30 with interest what would be everones opinion to claiming would you claim with or without interest??
Also im claiming from HSBC where do i sent the initial letter??

nationwide took my £1500 overdraft off me last year and within six months i owed them £2500 which i am now paying off through a debt coll agency, after seeing this site i sent the first letter to them requesting a breakdown and gave 40 days which is up on 18th mar. i received a letter explaining their charges but not a mention of comp. list i requested!!!
i have rang them 3 times since and each time been fobbed off, :rolleyes: and dont know what to do next!!!!!
they actually rang and left message with my mum(clearly not up on the data protection lark!!!) saying they would chargeme £10 per statement total of £720!!!
when i rang back they conveniently had no record of this happening and said someone would call me.... they have not!!!!

Story - Started proceedings 4 december and was finalised this morning 12 March 2007. Went all the way to the court case but im very hapy with them offering £500. Definitly worth the effort and wait.
Can anybody help with this query though? I paid £39 to go through the court and obviously have now settled out of court - am i able to try and reclaim this - if not its ok but thought I might ask.0 -

If they haven't replied withing the 40 days, send them another letter giving them a further 7 days or you will go to the Information Commisioner!
I personally don't like dealing with the banks over the telephone and like everything in writing as you have no proof of what they say etc. :rolleyes:0 -

They do not accept their own charges are lawful ? If that line in the letter actually reads like that and isnt your own typo then thats hilarious.
As to anyone getting anywhere with egg, there is a post in the success thread (gleaned from a search of info I've copied for research from page 50 up to date. One guy claimed a £20 charge back and got it in full.
Disregard this letter it is worded to make you falter and the OFT decision has no bearing on the law. Keep going with your claim and good luck0 -

my sister in law has written to her bank requesting her 6 years statements, and they have written back asking her for 100 pounds (sorry pound sign not working) for the statements!!! can they do this ?

Providing you asked for you charges/statements under the DPA using the template letter then the most they can charge is £10 and they have 40 days to provide them..... If you just asked for your statements for the last 6 years with no mention of the DPA then they can charge you per statement..... You must ask for a list of you charges under the DPA but will accept statements if thay cannot provide a list of charges, this is basically what the first letter says.....0
