hi,
i have been looking into chasing my bank for my charges and they are £1857 without interest its £2140.30 with interest what would be everones opinion to claiming would you claim with or without interest??
Also im claiming from HSBC where do i sent the initial letter??

Hi Lou,
I am very new to this too, but I believe you can only claim the interest once you are starting court proceedings, my claim has now gone to the court proceedings stage and yes I have claimed for interest, it added quite a lot to my claim. If I were you i would go ahead with my claim for 1857, and if (when) you get to start court proceedings you can add the interest then.
They have got away with this for far to long, so you may as well go for as much as you can.

The choice is ultimately yours but although you are not entitled to the interest until it goes to court it is useful as a bargaining item i.e if they make you a offer close to your claim you could come back to them with a offer that you'll accept the full amount of charges and drop the claim for interest..
Watch Martin's video as he states until it goes to court it is a negotiation and you need a little extra to negotiate with, I've claimed the interest from the begining so it's always there to be bargained with, but up to you....

They do not accept their own charges are lawful ? If that line in the letter actually reads like that and isnt your own typo then thats hilarious.
As to anyone getting anywhere with egg, there is a post in the success thread (gleaned from a search of info I've copied for research from page 50 up to date. One guy claimed a £20 charge back and got it in full.
Disregard this letter it is worded to make you falter and the OFT decision has no bearing on the law. Keep going with your claim and good luck

Lloyds TSB Credit Card (formerly Scottish Widows).
I issued Court proceedings against LLoyds TSB for the recovery of £401 plus
interest £57.77 and court fees of £50 total £508.77. They have defended the
claim and I have an Allocation Questionnaire to return this week. I have tried
to deal directly with their Card Concerns people as the Courts suggest that
you try to strike a deal. I spoke to them again this morning and there was
an admission from them that they defend about one in twenty claims through
the Courts.
During the call, I was amazed that they are now quoting the OFT statement
as a form of defence in that they will pay the difference between the original charge and the £12 suggested by OFT. They have offered me £160.08 in full
and final settlement. In their letter initially informing me that they would not
pay anything, they state that they do not agree with the OFT interpretation of the law. Yet they are trying to apply it with their final offer.
Sadly this will now go to Court next week, it must have cost Lloyds what I am
claiming in the administration and defence through lawyers.
Their defence notes state that:
the charges are for Credit Card Services, and are not dmages nor a penalty;
the Bank is entitled by contract to impose the charges, which are fair and
reasonable;
it is denied that the charges are unlawful or contravene any statute or
regulation.
The claimants claim is denied in it's entirety. It is further denied that the claimant is entitled to the sum claimed or to any sum from the Bank.
At least this Bank is admitting that it is a claim, unlike more recent suggestions that it is a complaint against the Banks.0 -

As bank charges seem to be flavour of the month in the national press I thought i'd jump on the band wagon and see if I could claim some charges back from my bank.
I bank with the Abbey and they have charged me a few times over the years for certain instances on my account.
Before I go full steam ahead has anyone else who banks with the abbey had any success in doing this?
Also has anyone had their account closed down with the Abbey once they have been given back their charges?
Your feedback would be greatly appreciated.

I have a closed account with First National and I sent a letter to them requesting statements. The 40 days is up tomorrow and haven't heard a thing.
However, I sent my letter to the following which I had on one old statement I found:
First National Tricity Finance Limited
London Road
Preston
PR11 1UP
But, by searching about on the internet I think I should have sent it to
First National
GE Capital Bank
PO Box 720
Leeds
LS9 7TR
Is this correct?

Hmmm. The defence states the claim is denied in its entirety yet offered a partial settlement. They seem a tad confused there. Good luck0
